---------- 11/ 02.07.2025 The grievance of the petitioner in the instant writ application is with regard to compassionate appointment on account of death of his mother on
28.05.1992. 2. The instant application was preferred on 17.12.2008 i.e. more than 16 years from the date of death of the petitioner’s mother. The writ application was disposed of on 29.06.2012 with a direction to the respondents to consider the case of petitioner. Thereafter, an appeal was filed by the respondent being LPA No. 55 of 2013 which stood dismissed on 04.07.2013 and subsequently, review application being Civil Review No. 95 of 2013 was filed and the said review application was allowed vide order dated
19.11.2014. Thus, this case is listed for hearing today. 2025:JHHC:17652 2
3. It goes without saying that against the order passed in civil review the petitioner has also filed an LPA No. 549 of 2014 which was dismissed on 29.01.2024. 4. However, few facts are evident from records that the deceased employee died on 28.05.1992 and as per Annexure-1 to the writ application, it appears that the said letter was issued to the petitioner and one of his relative namely, Om Prakash Jha, indicating therein that there are rival claims from two persons and as such, the petitioner was directed to produce declaratory decree from a competent Court of law. 5.
Thereafter, the said letter was challenged by the petitioner before this Court in which vide order dated 29.06.2012, a direction was made to the respondents to take decision in the matter and subsequent history of the case has already been indicated hereinabove. 6. But the fact remains that we are in 2025 and the death occurred in the year 1992 and as such, at this moment, no relief can be granted to the petitioner. Even otherwise, when there is claim and counter-claim, onus lies upon the petitioner to produce succession certificate for claiming his right for being appointed on compassionate ground. 7. Accordingly, the instant writ application stands dismissed. (Deepak Roshan, J.) kunal/-
