GP FOR HOME (AP) The Court made the following: 3 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.19710 OF 2019 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: “….to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents police particularly 5th respondent in not registering the FIR basing on the complaint of the petitioner dated 28.10.2019 even though after receipt of the said complaint not to register the FIR is illegal, arbitrary and against the principles natural justice and also violation of Article 14, 19, 21 and 300-A of Constitution of India including the Apex Court Judgment Lalita Kumari Vs. Government of Uttar Pradesh and consequently direct the respondents police to register the FIR and to take action against the unofficial respondent No. 6 basing on the complaint of the petitioner dated 28.10.2019 in the interest of justice.” 2. None appeared for the writ petitioner. 3. Learned Additional Government Pleader for Home on written instructions would submit that basing on the report of the writ petitioner, police registered FIR vide Cr.No.176/2019 of Guntakal Rural Police Station, Ananthapuram District, for the offence U/s.506 IPC and U/s.3(1)(R)(S), 3(2)(V)(A) of SC/ST (PoA) Act, 1989 and 4 investigated into the case, and laid charge sheet vide S.C.No.31/2024, and presently the said Sessions Case is coming for trial before the concerned Special Court. 4. The writ petition is filed alleging that police did not register FIR basing on the report of the writ petitioner. Now the report of the learned Additional Government Pleader for Home would disclose that police registered the above case and investigated into the same, laid charge sheet before the Special Court, and the same is coming for trial. 5. In that view of the matter, the writ petition has become infructuous, and liable to be dismissed. 6. Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. As a sequel thereto, interlocutory applications, if any, pending in this Writ Petition shall stand closed. ______________________________ JUSTICE B.V.L.N.
