The order dated 01.07.2024 has been brought to the notice of this Court wherein directions have been passed in WPA 24237 of 2024 which is as follows” “As such, the learned ACJM, Barrackpore is directed to take personal bond from the petitioner no.1 and the petitioner no.2 as also keep an attachment of Rs.3 lakh in each of the Savings Account(s) and the Fixed Deposit Accounts being Savings Bank Account No.30233375256 and Fixed Deposits being Fixed Deposit Account Nos.40527033349, 38782249965 and 2 41123425328 (Petitioner No.1) and Savings Bank Account No.30234322893 and Fixed Deposit Account Nos.40119191312, 42043473601, 41748687677 and 41748688150 (Petitioner No.2). So far as the rest of the money relating to the aforesaid Savings/Fixed Deposit Accounts are concerned, the petitioner no.1 and the petitioner no.2 in usual course of life should be allowed to utilize as per their conveniences and there should not be any impediment for the pending criminal case.” In view of the earlier order, the State Bank of India, Sodepur Branch is directed to keep an attachment of Rs.3 lakhs Fixed Deposit in connectin with Savings Account No.30233375256. Another Rs.3 lakhs amount be attached in respect of Savings Bank Account No.30234322893. Rest of the accounts and amount which has been maintained with the Savings Bank Account as well as the Fixed Deposit which were invested from those accounts be allowed to be used/operated by the petitioners. Consequently the operating part of the order dated 12.08.2025 passed by the learned Judicial Magistrate, 3rd Court, Barrackpore is set aside. Accordingly CAN 2 of 2025 is disposed of. 3 All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
