The petitioners have filed the present contempt petition for implementation of order dated 13.12.2024 passed by the writ Court whereby the writ petition of the contempt petitioner has been decided in terms of the judgment passed by the Division Bench of this Court in LPA No. 38/2019. A perusal of the judgment dated 07.06.2023 passed by the Division bench of this Court reveals that while acquisition proceedings have been held to have lapsed in terms of Section 11-B of the J&K Land Acquisition Act, the respondents have been given right to initiate fresh land acquisition proceedings under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, if they require the land in question. 2. It is clear from the order passed by the Division Bench that there is no direction against the state to acquire the land in question but they have only been given right to initiate fresh land acquisition proceedings if they require the land in question. The land of the contempt petitioner is admittedly in his possession and as such, in the absence of a direction to the respondents-contemnors to acquire the said land, the present contempt Sr. No. 1 2 CCP (S) No. 269/2025 petition is not maintainable. However, it is provided that if the respondents-contemnors intend to acquire the land of the contempt petitioner or if they intend to use it for any purpose whatsoever, they are bound to proceed in accordance with the observations made in the judgment passed by the writ Court read with judgment passed by the Division Bench. 3.
