This petition under Section 528 of the BNSS has been filed for extension of time to deposit the fine amount of Rs. 5,000/- as per order dated 01.07.2019 passed by this Court in Cr.R. No. 388/2011. 2. This Court, vide order dated 01.07.2019, while partly allowing the revision petition and sentencing the petitioner to the period already 2 undergone, had directed the applicant to pay an additional fine of Rs.5,000/- within six months from today, failing which he shall have to undergo RI for two months. 3. Learned counsel for the petitioner submits that the petitioner was out of State for his livelihood, thus, he could not comply the order passed by this Court in Cr.R. No. 388 of 2011 on 01.07.2019. He further submits that in view of the above facts and circumstances of the case, the non-payment of fine amount of Rs. 5,000/- is unintentional and bonafide, therefore, the petitioner most humbly and respectfully prays that, further time may kindly be extended to deposit the fine amount of Rs. 5,000/- before the concerned trial Court as per order dated 01.07.2019 passed by this Court in Cr.R. No. 388 of 2011. 4. Learned counsel for the other side has no objection. 5. The prayer made by the petitioner appears to be reasonable. Hence, the petitioner is granted further 15 days’ time and no more time from today to deposit the enhanced fine amount as was ordered by this Court on 01.07.2019 in Cr.R. No. 388 of 2011. 6. Accordingly, this Cr.M.P. stands disposed of. 7. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance.
