GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 19689/2024 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents particularly 3rd respondent at the instance of respondent Nos.5 to 7 in insisting the petitioners to yield the terms of respondent Nos.5 to 7 by conveying petitioners properties to the respondent Nos.5 to 7 for affecting compromise in Crime (FIR) No. 137/2024 on the file of Tulluru Police Station as the illegal, irregular, irrational, without any authority of law and violative of Articles 14 and 21 of Constitution of India and consequently direct the respondents' particularly 3rd respondent not to interfere in any manner with petitioners' life, liberty and properties nor insist them to enter into any compromise…” 2. Heard Sri Kishore Kumar Katari, learned counsel for the petitioners and Sri P.Ajay Babu, learned Assistant Government Pleader for Home for the official respondents. 3. Learned Assistant Government Pleader for Home, on written instructions would submit that basing on the complaint of the 5th respondent, a case in Cr.no.137 of 2024 on the file of Tulluru Police Station was registered against the petitioners under Sections 304-B of IPC. He would further submit that the petitioners herein affected compromise with 5th respondent in the above crime by offering Ac.0.02 cents of house site. Thereafter, the 5th respondent approached the 3rd respondent herein and made a representation stating that she did not accept the proposal for compromise but at the request 4 of elders signed on the agreement in a semi conscious state due to her daughter’s death. As such, the respondent-police have called both the parties to the police station and enquired into the matter and advised them to resolve their issues relating land disputes in competent Civil Court. 4. Learned counsel for the petitioners would submit that the Court may pass appropriate Orders. 5. Recording the above said submissions, this Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties, except under due process of law. No order as to costs.
