1.
NJS,J C.R.P No.2411 of 2025 2
The Court made the following Order:
Heard Ms. B Radhika, learned counsel for the petitioner appearing through online.
2. Despite service of personal notice, as per the memo of proof of service dated 28.10.2025, none entered appearance on behalf of the respondent.
3. The grievance of the petitioner, who is the defendant No.5 in O.S No.77 of 2021 on the file of the Court of Junior Civil Judge, Palamaner, Chittoor District, is that the application i.e., I.A No.107 of 2025 filed under Order VII Rule 11(a) of Code of Civil Procedure is not taken up for consideration for disposal.
4. The said suit is filed by the respondent herein, seeking the decree for permanent injunction, restraining the defendants, their men and agents etc from in any way interfering with the plaintiff’s peaceful possession and enjoyment of the plaint schedule property.
5. From the material on record, it appears that the concerned Presiding Officer is on Training and probably that may be the reason for the matter being adjourned, due to non-availability of the Presiding Officer. Be that as it may.
6. As the innocuous relief sought for by the learned counsel for the petitioner is early disposal of the said I.A., this Court without going into the merits of case deems it appropriate to dispose of the Civil Revision Petition,
NJS,J C.R.P No.2411 of 2025 3
providing that the learned Junior Civil Judge, Palamaner, Chittoor District, shall make endeavor to dispose of I.A No.107 of 2025 in accordance with law, as expeditiously as possible, within a period of three (03) months from the date of receipt of copy of this order.
7. With the above direction, this Civil Revision Petition is disposed of. No costs. Miscellaneous petitions pending, if any, shall stand closed. __________________________ JUSTICE NINALA JAYASURYA Date:31.10.2025 Ksj
