GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 13211 of 2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent interfering in the civil disputes and harassing the petitioners and their family members relating to Sy.No.141/5B1 (telugu B), 16/1G/2(telugu G), 18/B(telugu B), 18/B1(telugu B) and 16/1G/1 (telugu G) of an extent of Ac.0.03cents, Ac.0.66cents, Ac.2.00cents, Ac.2.01cents and Ac.0.66cents total Ac.5.36cents situated at Venkatadasaripalli Revenue Accounts, Pulicharla Mandal, Chittoor District as illegal, arbitrary and unconstitutional and consequently direct the 3rd Respondent not to interfere in the civil disputes without due process of law.…” 2. Heard Sri T.Nagaraja, learned counsel for the petitioners and Sri P.Ajay Babu, learned Assistant Government Pleader for Home for the respondents. 3. Learned counsel for the petitioners would submit that the respondent- police are interfering with the civil disputes and harassing the petitioners and their family members. 4. Learned Assistant Government Pleader for Home, on written instructions, would submit that one Smt. Chandrakala has given a representation in the Sannitham Grievance Petition dated 29.04.2023 before the Inspector of Police, Kalluru and the same was endorsed to the Sub- Inspector of Police, Kalluru to enquire into the matter. During the course of enquiry, it came to light that the subject matter is civil in nature and the police 4 have advised the complainant to approach the competent civil court. He would further submit that the police are not interfering in the civil disputes between the petitioners and third parties. 5. Recording the same, this Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties, except under due process of law. No order as to costs.
