This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “to issue a writ, order or direction more particularly one in the nature of a writ of mandamus declaring the high handed action of the respondents No.4 and his subordinates in interfering in with my rights over the land in an extent of Ac.1.50 Cents in Sy.No.1037/4 of Madakalavaripalli Village fields, Gopavaram Mandal, Kadapa District at the behest of respondent No.5 as arbitrary, illegal, contrary to the well established legal principles apart from being vioaltive of fundamental and constitutional rights guaranteed us under article 14, 19, 21 and 300-A of the Constitiution of India and consequently direct the respondent No.4 and his subordinates not to interfere with my rights over the land in an extent of Ac.1.50 Cents in Sy.No.1037/4 of Madakalavaripalli Village fields, Gopavaram Mandal, Kadapa District…” 2. Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. 3. The learned counsel for the petitioner submits that the petitioner is the absolute owner and possessor of the subject land admeasuring an extent of Ac.1.50 cents in Sy.No.1037/4 of Madakalavaripalli village fields, Gopavaram Mandal, Kadapa District, having acquired the same through his vendor by way of an unregistered document dated 28.06.1999. Since then, the petitioner has been in peaceful possession and enjoyment of the subject land, and his name has also been mutated in the revenue records. While so, the 4th respondent is now attempting to interfere with the petitioner’s rights over the subject land at the behest of the 5th respondent and to evict him from the subject property without issuing any notice and without following due process of law. Hence, the present writ petition. 4. On the other hand, the learned Government Pleader for Revenue appearing for the respondents has furnished written instructions dated 10.12.2025 issued by the 4th respondent/Tahsildar, wherein it is stated that the 4th respondent has never interfered with the petitioner’s possession over the subject land. 5. Considering the submissions made by the learned counsel on either side and upon perusal of the material available on record, this Court is of the considered view that, in view of the written instructions furnished by the respondent authorities, the writ petition can be disposed of by granting liberty to the petitioner, in the event of any grievance with regard to the actions of the 5th respondent, to approach the competent civil court for appropriate relief, in accordance with law. 6. Accordingly, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions pending if any, shall stand closed. ________________________ JUSTICE D.
