The petitioner has filed this petition seeking the following relief(s):- 10.1 Issue an appropriate writ/order/direction to the respondents department/authorities to consider the case of the petitioner regarding grant of compassionate appointment to him, on the post he is eligible for, on account of death of his father Late Shri Parmeshwar Dewan, within stipulated time which Hon’ble Court deems fit, in the interest of justice. 10.2 Cost of the petition. 10.3 Any other relief as deemed fit by this Hon’ble Court. 2. Mr. Arvind Shrivastava, learned counsel appearing for the petitioner would submit that the father of the petitioner namely Late Shri Parmeshwar Dewan, who was working on the post Phone Attendant, Digitally signed by RAMESH KUMAR VATTI Date: 2025.09.11 15:06:38 +0530 2 died in harness on 25.04.2021. He would submit that an application for grant of compassionate appointment was moved by the petitioner on 18.05.2021 and reminder letters were sent on 18.07.2022, 20.07.2022, but till date no decision has been taken. He would further contend that sister of the petitioner namely Nilima Dewan has also moved an application for grant of compassionate appointment which is pending consideration before the respondent authorities. He would pray that a direction may be issued to the respondent authorities to decide the applications moved by the petitioner and his sister for grant of compassionate appointment strictly in accordance with the existing policy. 3. On the other hand, Mr. Topilal Bareth, learned Panel Lawyer appearing for the State/respondents would oppose. He would submit that as there is dispute between the brother and sister, therefore, the matter has not been decided yet. 4. Heard learned counsel for the parties and perused the documents. 5. Considering the submissions made by the respective Advocates, this petition, at this juncture, is disposed of with a direction to the respondent authorities to decide the pending applications moved by the petitioner and his sister for grant of compassionate appointment according to their eligibility and entitlement in accordance with the existing policy preferably within a period of 90 days from the date of receipt of copy of this order. 6.
