Order 16/12/2025 The instant bail applications have been filed under Section 483 B.N.S.S. on behalf of accused-petitioners in the matter arising out of F.I.R. Nos.398/2015 registered at Police Station Sikri District Bharatpur for the offence(s) punishable under Section(s) 302, 201 & 120-B of I.P.C.
[2025:RJ-JP:50795] (2 of 3) [CRLMB-12974/2025]
Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case, they have nothing to do with the alleged offence(s) and they are behind the bars since 11.08.2025. Counsel further submits that the alleged incident took place on 14.12.2015 and upon completion of investigation, the Investigating Officer submitted a negative final report on 31.12.2016. Thereafter, the complainant filed a protest petition, pursuant to which the learned Trial Court took cognizance and issued arrest warrants against the eight accused-persons including present petitioners, vide order dated 19.06.2025. Counsel further submits that apart from present petitioners, other six co-accused persons approached this Court by filing a petition(s) under Section 482 Cr.P.C. and the Coordinate Bench of this Court while allowing the said petition(s), converted the arrest warrants into bailable warrants and directed the said co-accused persons to furnish bail bonds before the learned Trial Court. In compliance thereof, all the six co-accused persons have already furnished their bail bonds. Counsel further submitted that the present petitioners were subsequently arrested by the police and therefore, present bail applications have been preferred. It was argued that in view of the negative final report submitted by the Investigating Officer and the contradictions in the statements of the prosecution witnesses, the petitioners deserve to be enlarged on bail. Learned Public Prosecutor and learned counsel for the complainant-respondent have vehemently opposed the bail applications and submitted that the Investigating Officer
[2025:RJ-JP:50795] (3 of 3) [CRLMB-12974/2025] submitted a negative final report, which was erroneous. It was contended that the complainant, therefore, preferred a protest petition and, thereafter, the learned Trial Court took cognizance. Heard learned counsel for the parties and perused the material available on record. Taking into consideration the submissions put forth, evidence adduced in support of the protest petition & during investigation, and overall facts & circumstances of the case but without commenting upon detailed merits of the case, this Court deems it fit to enlarge the accused-petitioners on bail. Therefore, the bail applications are allowed.
Accused- petitioners, namely Vikramsingh S/o Jasbant Singh & Pujari S/o Kanniram, shall be released on bail, if they are not required in any other case, provided each of them furnishes a personal bond in the sum of Rs.50,000/- (Fifty Thousand) together with two sureties in the sum of Rs.25,000/- (Twenty-five Thousand) each to the satisfaction of the learned Trial Court with the stipulation that they shall appear before that Court and any other Court to which the matter is transferred, on all subsequent dates of hearing and as and when they are called upon to do so.
