Aslam Gani Bagwan … Respondent None for the petitioner. Ms. Manisha Devkar a/w Mr. Shankar Katkar for respondent. CORAM : AMIT BORKAR, J. DATED : JANUARY 16, 2025 P.C.: 1. The petitioner (original defendant) is challenging the concurrent judgment and orders passed by the Courts below granting temporary injunction against the petitioner restraining her from disturbing plaintiff’s possession over the suit property and not to evict plaintiff forcibly. 2. On perusal of the record, it appears that the order of injunction is in respondent’s favour since 30th May 2020. Hence, at this stage, no interference is called for. 3. However, the Trial Court shall decide the suit on its own merits uninfluenced by the observations made in the impugned order. 1 SHABNOOR AYUB PATHAN Digitally signed by SHABNOOR AYUB PATHAN Date: 2025.01.16 15:43:47 +0530 15-wp-13472-2022.doc 4.
