HON'BLE MR. JUSTICE ANIL KUMAR UPMAN
Order 16/12/2025 Instant criminal misc. petition has been filed under Section 528 BNSS for quashing of FIR No.715/2023 registered at Police Station Jhotwara, District Jaipur (West) for the offences punishable under Sections 420, 406, 467, 468, 471 & 120B of IPC.
Learned counsel for the petitioners submits that on two occasions, negative final report was proposed but in the garb of further investigation, petitioners are being harassed by Investigating Agency. It is submitted that there is money dispute between the parties and complainant wants to settle the money dispute in the garb of criminal investigation in the impugned FIR.
[2025:RJ-JP:50841] (2 of 2) [CRLMP-4300/2025] In pursuance of the directions issued by this Court, learned State counsel has placed factual report dated 26.11.2025 of the investigation, which is taken on record. As per the factual report, after thorough investigation, the Investigating Agency has found the impugned FIR lodged against the petitioners to be false and proposed a negative final report in the matter. Vide order dated 19.11.2025, the file of investigation has been forwarded to the Crime Branch, Police Commissionerate, Jaipur. In view of above, prayer made in this criminal misc. petition does not survive any more. Accordingly, the instant petition is dismissed as having rendered infructuous. Stay application and misc. application(s), if any, also stand dismissed. However, it is made clear that petitioners would be at liberty to file fresh petition, if need arises. Learned State counsel is directed to submit the result of investigation before the concerned court on or before 31.01.2026.
