Neutral Citation No. - 2025:AHC:58387 Court No. - 5 Case :- WRIT - A No. - 5045 of 2025 Petitioner :- Dr. Anjum Gupta Respondent :- Union Of India And 3 Others Counsel for Petitioner :- Asha Parihar,Pratik Chandra Counsel for Respondent :- A.S.G.I.,Manav Chaurasia,Maneesh Kumar Hon'ble Ajay Bhanot,J. The petitioner claims that she is entitled to age relaxation and regularization of her services. A representation in this regard has been made but to no avail. The only prayer made by Shri Pratik Chandra, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Shri Niraj Dubey, learned counsel assisted by Shri Aditya Dubey, learned counsel for the respondent no. 4 and Shri Manav Chaurasia, learned counsel for the respondent nos. 1, 2, and 3 submit the matter requires factual determination as per applicable law by the competent authority in the first instance. The claim of the petitioner needs to be ascertained whether she was appointed by the corporation on its rolls, or was a contractual employee engaged by the contractor. However, they fairly contend that the claim of the petitioner for age relaxation and regularization of her services is liable to be decided within a reasonable time frame. In wake of the preceding discussion and without going into the merits of the case, the respondent no. 4 is directed to decide the representation of the petitioner regarding age relaxation and regularization of her services within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. It is clarified that this Court has not gone into the veracity of the assertions made in the writ petition nor has judged the claim of the petitioner on merit. It is for the competent authority to do so after independent application of mind and in accordance with law. With the aforesaid direction, the writ petition is finally disposed of.
