PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused No.2 for granting of pre-arrest bail in connection with Crime No.116 of 2025 of Singanamala Police Station, Ananthapuramu District, registered for the alleged offences punishable under Sections 109(1) and 118(1) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2
2. The learned Assistant Public Prosecutor submits that the petitioner is aggressor. There are specific overt acts attributed against the petitioner. The investigation is at progressive stage and it is urged to dismiss the petition. 3. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 4. As seen from the record, the petitioner is a female aged about 42 years. She is the wife of Accused No.1, who has already been arrested and is in judicial custody. There is a land dispute between the de-facto complainant and the father of the petitioner. The injured sustained only simple injuries in nature. Based on the report of the de-facto complainant, a case in FIR No.116 was registered. Accused No.1, who is the husband of the present petitioner, also lodged a report, which was registered as Crime No.117 of 2025. 5. The learned Assistant Public Prosecutor submits that, although the two cases are case and counter-case, the petitioner and the other accused were the aggressors in the alleged incident. So far, six witnesses have been examined. 6. Considering the facts and circumstances of the case, gravity and nature of the allegations levelled against the Petitioner/Accused No.2, this Court is inclined to grant pre-arrest bail to the Petitioner/Accused No.2. 7.
In the result, the Criminal Petition is allowed with the following conditions: i. In the event of arrest of the Petitioner/Accused No.2, she shall be enlarged on bail subject to her executing a self-bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for the like sum each to the satisfaction of the arresting police officials. 3
ii. The Petitioner/Accused No.2 shall make herself available for investigation as and when required. iii. The Petitioner/Accused No.2 shall not cause any threat, inducement or promise to the prosecution witnesses. iv. The Petitioner/Accused shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. v. The Petitioner/Accused No.2 shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. vi. The Petitioner/Accused No.2 shall surrender her passports, if any, to the investigating officer.
