THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY £BIMINAL PETITION NO: 600 of 2lg2§ ORDER: The Criminal Petition, u/See.482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioner/accused to grant anticipatory bail in connection with cr.No.04/2025 of Cyber Crime Police Station, Visakhapatnam commissionerate. 2. A case has been registered against the petitioner and others for the offences punishable under Sections 111 (2), 319(2), 318(4) I/w 61 (2) B.N.S and 66-C, 66-D of the I.T.A. Act and 3 and 4 of the A.P.Gaming Alct. 3. Case of the prosecution in brief I'S that On 06.01.2025 at about 8.30 pm, on receipt of credl'ble information about cricket betting, the Inspector of Police, Cyber Crime police station, visakhapatnam Commissionerate along with staff and mediators went to Flat No.610, Gayatri Towers, Opp. Water tank and pump house, back side of Polamamba temple, Doctors Colony, Pedawaltair, Visakhapatnam and found A3 with a laptop and two mobile phones. On enquiry, A3 disclosed his identity particulars and police seized the said laptop and two mobile phones and he disclosed that he used to do cricket betting offline and online by collecting money either online or by way of cash. Police arrested him and got remanded him to judicial custody. 4. Heard. Perused the record. 5. Learned Assistant Public Prosecutor submits that investigation is at crucial stage and some more witnesses are to be examined. GZ,-<#/ - 6. A perusal of the material available on record goes to show that, except the offence under Section 111(2) BNS, all other offences which are alleged as against the petitioner, are punishable with imprisonment up to seven years. Learned counsel appearing for the petitioner submits that Section 111(2) BNS would not attract as against the petitioner for the reason that there are no other cases registered as against the petitioner herein. 7. Learned Assistant Public Prosecutor agreed with the submissions made by the learned counsel for the petitioner herein. In view of the same, this Court is inclined to consider the prayer of the petitioner/ accused for grant of anticipatory bail. 8. Accordingly, in the event of his arrest with regard to this crime, Petitioner/accused Shall be released on bail on hl-s executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only), with two sureties each for the like sum to the satisfaction of the arresting police officials and also on condition that the petitioner shall make himself available for investigation as and when required and that he shall not Cause any threat, inducement Or Promise tO the Prosecution Witnesses. The petitioner shall appear before the Station House Officer concerned, once in a week i.e. on every Sunday between 10.00 a.m. and 05.00 p.m., till filing of the charge-sheet. 9.
