1. Heard Shri Love Kumar Ramteke, learned counsel for the petitioner. Also heard Shri Shailendra Sharma, learned Panel Lawyer for the State/respondent no. 1. 2. The present Cr.M.P. has been filed with the following prayer:-
“ It is therefore prayed that this Hon’ble Court may kindly be pleased to quash the FIR No. 528/2025 dated 11.05.2025 lodged by Police Station Supela, Charge Sheet No. 327/2025 dated 22/05/2025 and criminal case No. RCC/21535/2025 registered under Section 296, 351(3) BNS, 2023 by the Hon’ble Chief Judicial Magistrate, District-Durg taking cognizance of the offence against the petitioner, the next hearing of which is on 04/09/2025, in the interest of justice”. 3. During the course of hearing, it is apparent that the petitioner herein is the daughter-in-law of the respondent No.2 and on an earlier occasion the petitioner has lodged an FIR against the respondent No.2 for the offence under Section 498-A of the IPC, however, copy of the same has not been annexed with
3 the petition and even there is no whisper about the said fact in the pleadings of the instant petition. 4. At this juncture, learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to file a fresh petition. 5. Learned State counsel has no objection. 6.
In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with liberty as prayed for, subject to the petitioner depositing a sum of Rs. 2,000/- as costs before the Registry of this Court and producing the receipt of the same at the time of filing of the fresh petition, if any. The amount so deposited shall be transmitted to the Government Special School for Intellectually Retarded Girls Gaganpur, Ambikapur, District Surguja (C.G.). 7. Certified copies of the FIR, charge-sheet, and other documents, if any, may be returned to the petitioner after retaining photocopies of the same.
