By way of this petition, the petitioner has prayed for following relief:- Digitally signed by RAGHVENDRA JAT 2 “10.1 That this Hon'ble Court may kindly be pleased to issue an appropriate writ, thereby directing the respondent authorities to decide the pending application of petitioner for transferring her services in District Durg, within stipulated time, in view of Clause- 1.3 of policy of State Government dated 03.06.2015. 10.2 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.” 2. Brief facts of the case, is that, upon successful completion of recruitment process, vide order dated 10.08.2016, the petitioner was appointed on the post of Hostel Superintendent Class-D and she was directed to join her services at Pre-Metric Girls Hostel, Chhachhanpairi, Block-Chowki, District-Mohla- Mannpur- Ambagarh-Chwoki and accordingly the petitioner joined her services and since then the petitioner is discharging her duties with utmost sincerity and honesty, upto the satisfaction of her superior authorities, without any stigma or complaint. He further submits that the husband of the petitoner is also a government servant and presently the husband of petitioner is posted as Data Entry Operator in the Office of Commissioner, Land Record Chhattisgarh, Nawa Raipur. He further submits that the State 3 Government has issued circular/policy dated 03.06.2015 and Clause- 1.3 of said circular prescribes that the newly recruited employee shall be posted for period of 2 years in core scheduled area or 3 years in normal scheduled area. The Block Ambagarh Chowki is defined as normal scheduled area and the petitioner has already served 8 years in the normal scheduled area, therefore, in view of policy of State Government to keep husband and wife in same Division, the petitioner made representation dated 31.08.2022 before the respondent no. 2 for transferring her services from present place of posting. He further submits that though the husband of petitioner is posted in Raipur, but the petitioner and her husband are living in Village Umarpoti, District- Durg, therefore, the petitioner is seeking transfer of her services in District Durg. On 27.08.2024, the petitioner has made reminder for transferring her services from present place of posting, but till date the representation of the petitioner has not been decided. 3. Learned counsel for the petitioner submits that the State Government has issued circular/policy dated 03.06.2015 and Clause-1.3 of said circular prescribes that the newly recruited employee shall be posted for period of 2 years in core scheduled area or 3 years in normal scheduled area and thereafter such employee shall be posted in non- scheduled area. 9.3 Because, 4 the Block Ambagarh Chowki is defined as normal scheduled area and the petitioner has already served 8 years in the normal scheduled area, therefore in view of policy of State Government to keep husband and wife in same Division, the petitioner made representation dated 31.08.2022 before the respondent no. 2 for transferring her services from present place of posting. The husband of petitioner is posted in Raipur, but the petitioner and her husband are living in Village Umarpoti, District-Durg, therefore the petitioner is seeking transfer of her services in District Durg. Learned counsel for the petitioner is seeking a direction to the respondent authorities to consider and to post them in one place so that they may live their married life happily. 4. Respondent authorities are directed to consider and decide the representation in a pragmatic manner within a period of 2 months. 5.
