KOLLI USHA KIRANMAYEE, Advocate for the Petitioner and of PUBLIC PROSECUTOR for the Respondent and the Court made the following;~ 'T= ORDER:- This Criminal petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha sanhita, 2023, has been filed by the petitioners/A.1, A.5 & A.6, seeking regular bail, in Crime No.216 of 2024 of Sabbavaram Police Station, Visakhapatnam District. 2. A case has been registered againstthe petitioners herein and others for the offence punishable under section 2O(b)(ii)(C) read with 8(c), 25 of the Narcotic Drugs and psychotropic Substances Act,1985 (for short [the NDPS Act'). 3. Case of the prosecution, in brief, is that, on 18.O9.2024, at about 07.00 am, on receipt of credible information, the Inspector of police, Sabbavaram police station, along with his staff and mediators, while conducting vehicle checking, found A.1 to A.3 in possession of 30 Kgs of Ganja while transporting the same in an Auto and piioting wit'n a motorcycle. The contraband was seized under cover of mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. The petitioner/A.1 was arrested on 18.09.2024 and the petitioners/A.5 & A.6 were arrested on 22.09.2024 and since then they are languishing in judicial custody. The quantity of Ganja allegedly seized from the possession of accused is 30 Kgs. This Court already granted bail to A.3 while declining to grant ~bail to petitioner herein (A.1) and A.2 vide Crl.P.No.8524 of 2024 dated 09.12.2024. Learned Assistant Public Prosecutor submitted that major portion of investigation is completed and the charge sheet is yet to be filed. 6. In view of the aforesaid facts and circumstances of the case, as already this Court granted bail to petitioner/A.1 vide Crl.P.No.8524 of 2024 dated o9.12.2024, the Criminal Petition is dismissed in respect of petitioner/A.1 is concerned. However, this Court is inclined to grant bail to the petitioners/A.5 & A.6 on the following conditions: i) The petitioners/A.5 & A.6 shall be released on bail on their executing a personal bond for Rs.30,00O/- (Rupees Thirty Thousand only) with two sureties of the like sum each to the satisfaction of the learned I Additional District & Sessions Judge, Visakhapatnam. The petitioners are permitted to furnish the sureties from the State of Andhra Pradesh. ii) On release, the petitioners shall appear before the Station House officer concerned, twice in a month i.e., on lst and 15th of every month between 10.00 a.m. and 01.00 p.m., till filing of th.e charge sheet. iii) The petitioners sha" make themselves available for investigation as and when required and they shall not directly or indirectly make any inducement, threat or promise to any persons acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer. They shall not indulge in similar acts of crime and .± _\__ - + ~ sha" duly attend the trial of the case. The petitioners sha" regularly appear before the competent court and participate in pre-trial and trial process without fail. 7. Accordingly, the Criminal Petition is partly allowed.
