CORAM: HON'BLE MR. JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER This petition is filed by the husband/accused No.1 seeking quashing of the proceedings arising out of Crime No.124/2023, which has culminated in C.C. No.26024/2023, for the offences punishable under Sections 323, 498-A, 504 and 506 read with Section 34 of the Indian Penal Code, 1860, and under Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Learned counsel for the second respondent/complainant, drawing attention to the terms of settlement recorded in M.C. No.2475/2023, submits, on instructions, that the second respondent has no objection to quashing the proceedings against the petitioner. He further

HC-KAR NC: 2025:KHC:37174 CRL.P No. 1215 of 2024 submits that the marriage between the petitioner/husband and the respondent/wife stands dissolved by mutual consent and that, under the settlement, the petitioner has been granted visitation rights to meet the minor child born out of the wedlock.

This Court has carefully examined the memorandum of settlement placed on record and noted that, pursuant to the amicable resolution arrived at before the Mediation Centre, the marriage has been dissolved and the parties have amicably settled all their inter se disputes. Having regard to the fact that the wife has unequivocally expressed her consent for quashing the criminal proceedings, and in view of the dissolution of marriage and settlement of all matrimonial disputes, the continuation of the prosecution would serve no useful purpose and would amount to an abuse of the process of law.
4. In the circumstances, this Court finds it just and proper to exercise its inherent jurisdiction under Section 482 of the Code of Criminal Procedure to secure the ends of justice

ORDER i. The criminal petition is hereby allowed. ii. The proceedings in C.C. No.26024/2023, arising out of Crime No.124/2023 registered by Amruthahalli Police Station, and pending on the file of the VII Additional Chief Metropolitan Magistrate, Bengaluru, for the offences punishable under Sections 323, 498- A, 504, 506 read with Section 34 of IPC, and under Sections 3 and 4 of the Dowry Prohibition Act, 1961, insofar as they relate to the petitioner/accused No.1, are quashed.
