This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No. 120/2025 registered at Police Station Baikunthpur, District Koriya (CG) for the offences under Sections 61(2), 103, 238 of Bharatiya Nyaya Sanhita (BNS), 2023. 2. The prosecution case, in brief, is that a missing person report was registered on 26.03.2025 on the basis of information given by one Shanta Kurre regarding disappearance of deceased Ashok Kumar. On 29.03.2025, a Dehati Merg Intimation and Dehati Nalsi were registered regarding murder of Ashok Kumar. During investigation, it was found that deceased 2 used to harass his wife Shanta and daughter Sarita physically and mentally, due to which, they were likely to leave the house. Therefore, the present applicant Tausif Khan and his mother Sahnaaz Begum conspired with deceased’s wife Shanta Kurre and others to aliminate Ashok Kumar for a ransom of Rs.50,000/-. In execution of conspiracy of murder, on 19.03.2025 at around 11.00 p.m., the present applicant Tausif Khan together with co-accused Amanul alias Baba Khan, deceased’s daughter Sarita and deceased’s wife Shanta together committed murder of Ashok Kumar. 3. Learned counsel for the applicant submits that the present applicant is 20 years old and only on the memorandum statements of other accused, he has been arrested and there is no background of criminal antecedents against him. He submits that similarly placed accused persons namely Smt. Sahnaaz Begam and Arbaaz Ansari have been granted bail by this Court in M.Cr.C.No. 4933/2025 and M.Cr.C.No.5936/2025 respectively, therefore, being in parity, the present applicant may also be enlarged on bail. He submits that the applicant is in jail since 31.03.2025 and till date, charges have not been framed and there is no immediate possibility of disposal of case, therefore, he may be enlarged on bail. 4. Per contra, learned State Counsel opposes the bail application and submits that the applicant is main accused and from his possession, knife (Chapad) and blood stained clothes were seized and the FSL report is still awaited. 5. Having considered the submissions made by learned counsel for the parties and the facts and circumstances of the case, I am not inclined to release the applicant on regular bail at this stage.
