The Court made the following order: This contempt case is filed against the respondents for willful disobedience of orders dated 27.04.2023 passed by this Court in W.P.No.19679/2019. 2. Heard Sri T.Srinivasulu, learned counsel for the petitioner and Sri Chandrasekhar, learned counsel representing Sri K.M.Krishna Reddy, learned counsel for contemnors. 3. Learned counsel for the petitioner contended that pursuant to orders passed by this Court in W.P.No.19679/2023, the petitioner made an application for issuance of D-Form patta on 03.07.2023 with regard to subject property to the concerned authorities. He further submitted that inspite of the orders passed this Court in W.P.No.19679/2023, the authorities have not passed any orders on the petitioner’s application submitted for issuance of D-Form patta. As such filed the present contempt case and prayed to punish the contemnors. 4. On the other hand, learned counsel for contemnors submitted that in the orders passed by this Court in W.P.No.19679/2023 dated 27.04.2023 there is no such direction issued to the authorities to pass orders on the petitioner’s application submitted for issuance of D-Form patta. In the said circumstances, the petitioner’s cannot file a contempt case in that regard. As such prayed to pass appropriate orders in that regard. 5. Perused the record and considered the submissions of both the learned counsel. 6. This Court has disposed of the W.P.No.19679/2023 on 27.04.2023 with the following direction: (a) The Respondent Authorities are directed not to interfere with the Petitioners possession house bearing Nos.123-18-1624 to 1629, situated in S.No.221-61, Swarna Bharathi Nagar, C-Block, 19th Lane, Adavi Thakkelapadu Village, Guntur Rural, Guntur District without following due process of law. However, though no relief is sought for issuance of D-Form Patta in favour of the petitioner to avoid multiplicity of litigation, the petitioners are at liberty to make representation for issuance of D-Form Patta to the concerned authorities and on such representation, the authorities are directed to consider petitioners representation in accordance with law. 7. While disposing the said writ petition, this Court has observed (in 4th para) that though the relief is not sought by the petitioners, the authorities may be directed to consider the petitioners representation, if any before the said authorities for issuance of D-Form patta in accordance with law and accordingly given liberty to make representation for issuance of D-Form Patta to the concerned authorities and on such representation the authorities are directed to consider petitioners representation in accordance with law. 8. Based on the said ground, the petitioner has filed the present contempt case alleging that the authorities have not complied with the orders of this Court, which is not tenable. This Court, in order to avoid the multiplicity of litigation, without there being any prayer, has given the liberty to petitioner to make a representation. It would be an independent course of action of the concerned official to pass orders on the said representation, as the petitioner has not sought for such relief in that regard. In view of the same, there lies no contempt against the respondents and contempt is liable to be dismissed. Accordingly, contempt case is dismissed. However, the petitioner is not precluded from approaching the appropriate authorities in accordance with law. No costs.
