Wangmo, learned State counsel appearing for respondent Nos. 1, 2 & 3 and Mr. M. Kato, learned DSGI for Union of India representing respondent Nos. 4, 5, 6 & 7. 2. By instituting this writ petition, the petitioners have prayed for a direction to the respondents to make payment of Rs. 52,26,900/- (Rupees Fifty-Two Lakh Twenty-Six Thousand Nine Hundred) only being the compensation amount assessed against the land measuring about 15000 Sqm at 3(three)locationsat Kharsa, namely, TongshengRholmang Teng, Glangbi Rong Brah and Kyui BrahRong, under Jang Sub-Division in Tawang Page No.# 21/23 District for Muck Dumping. 3. Having considered the stand of the Union of India, particularly, BRTF, represented by Chief Engineer, Project Vartak, this writ petition is disposed of at the admission stage. 4. Bereft of unnecessary details, the case of the petitioners is that the petitioners are the resident of Kharsa village. The construction of Jang Bypass Road from KM 275.00 to KM 287.156 on Balipara-Charduar-Tawang (BCT) road was commenced by the 90 RCC (GREF) in the year 2018 and said stretch of the bypass road passes through the community as well as private land of the villagers of the Kharsa. Before the commencement of work, it was agreed upon that no muck dumping would be made at the social forestry of Kharsa village and due care would be taken during the formation cutting of road to avoid damage to the social forestry.However, the construction agency was recklessly doing the formation cutting and dumping muck in the social forestry. Aggrieved of, a complaint was lodged on behalf of the villagers of Kharsa. Pursuant to the complaint dated 17.07.2018, all the stakeholders jointly carried out site verification for identification of muck dumping areas on 18.07.2018 and finally agreed upon for muck dumping on three locations, namely, TongshengRholmang Teng, Glangbi Rong Brah and Kyui Brah Rong. 5. The estimate cost ofRs. 52,26,900/- (Rupees Fifty-Two Lakh Twenty- Six Thousand Nine Hundred) only was assessed for compensation of landfor muck dumping at the said three locationsby the Additional Deputy Commissioner, Jang, District Tawang, which was forwarded to the Deputy Commissioner, Tawang on 03.06.2020. The Deputy Commissioner, vide letter dated 23.12.2020 has forwarded the estimate submitted by the Page No.# 22/23 Additional Deputy Commissioner, Jang to the Officer Commanding, 90 RCC (GREF), C/o 99 APO, respondent No.7 herein. 6. Mr. R. L. Thungon, learned counsel for the petitioners submits that despite submission of estimate for an amount of Rs. 52,26,900/- (Rupees Fifty-Two Lakh Twenty-Six Thousand Nine Hundred) only being the compensation amount in respect of the three places, namely, TongshengRholmang Teng, Glangbi Rong Brah and Kyui Brah Rong, which is a community land of the petitioners at Kharsa, for muck dumping for construction of BCT road as acquired by the BRTF, the respondent authorities, particularly, the Border Road Organisation has not paid the amount till date. Therefore, he submits that the respondents may be directed to pay the amount of Rs. 52,26,900/-(Rupees Fifty-Two Lakh Twenty-Six Thousand Nine Hundred) only, forthwith. 7. Mr. M. Kato, learned DSGI appearing for the respondent No. 4 to 7, by placing a copy of the communication dated 18.06.2025, fairly submits that the respondents have never denied paying compensation to the petitioners, the only hiccup is that due to lack of Demand Note of Rs. 52,26,900/-(Rupees Fifty-Two Lakh Twenty-Six Thousand Nine Hundred) by Civil Administration, the payment of compensation could not be made and the respondents are willing to do the necessary payment as and when the Demand Noteof Rs. 52,26,900/-(Rupees Fifty-Two Lakh Twenty-Six Thousand Nine Hundred) is received from theCivil Administration. 8. Having considered the submissions of the learned counsel for the parties, particularly the submission of the learned DSGI, on written instructions that the respondents are willing to pay the aforesaid compensation amount subject to receive of Demand Note ofRs. Page No.# 23/23 52,26,900/-(Rupees Fifty-Two Lakh Twenty-Six Thousand Nine Hundred) from the Civil Administration, I deem it appropriate to allow this writ petition with afollowing directions:- i) Deputy Commissioner, Tawang District, to send a Demand Note ofRs. 52,26,900/-(Rupees Fifty-Two Lakh Twenty-Six Thousand Nine Hundred) as per the policy and rules to the respondent Nos. 6, namely, the Chief Engineer, Headquarters, Project Vartak, C/o 99 APO, as expeditious but not later than 1 (one) month from today. ii) On receipt of Demand Note ofRs. 52,26,900/-(Rupees Fifty-Two Lakh Twenty-Six Thousand Nine Hundred) as agreed, the respondent No. 6 shall deposit the compensation amount before the Deputy Commissioner, Tawang within 2 (two) months from the receipt of the Demand Note of Rs. 52,26,900/-(Rupees Fifty-Two Lakh Twenty-Six Thousand Nine Hundred), thereafter, the Deputy Commissioner, Tawang shall disburse the compensation amount i.e. Rs. 52,26,900/-(Rupees Fifty- Two Lakh Twenty-Six Thousand Nine Hundred) to the land owners. 9.
