On the basis of the complaint filed by Machimanda Brijesh Madappa, Virajpet Rural Police have registered the case in Crime No. 130/2025 against the accused no. 1 for the offence punishable under Sections 109, 118(1), 352, 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023 and Section 3 and 25 of the Indian Arms Act, 1959. 2. It is submitted by the learned counsel for the petitioner that, the petitioner-accused No.1 is 78 years old and - 4 - HC-KAR NC: 2025:KHC:54779 CRL.P No. 17528 of 2025 the alleged injury is caused to the complainant on his left leg. It is further submitted that accused Nos.2 and 3 are released on bail with conditions. It is also submitted that there is a counter case. The accused has also filed complaint against the complainant Machimanda Brijesh Madappa in Crime No. 131/2025 dated 10.12.2025. Both pertains to the same incident. 4. Heard the learned counsel for the parties and examined the materials placed on record. 5. The case and counter case are registered in Cr.No.130/2025 and 131/2025 of Virajpet Rural Police Station. The alleged commission of offence are not punishable with death or imprisonment. The accused is not required for further investigation. Considering the age and occupation and also case and counter case between the parties, it is just and proper to allow this petition with conditions. 6. Accordingly, I proceed to pass the following: ORDER i) The bail petition is allowed. - 5 - HC-KAR NC: 2025:KHC:54779 CRL.P No. 17528 of 2025 ii) The petitioner/accused No.1 shall be released on bail on executing the personal bond of ₹ 2,00,000/- with two sureties for the like sum to satisfaction of the Court. iii) He shall not tamper with the prosecution witness directly or indirectly. iv) He shall not threaten or induce the complainant or his family members in any manner. v) He shall co-operate with the investigation and appear before investigating officer as and when required. vi) He shall not leave the jurisdiction of this Court without prior permission. vii) He shall mark his attendance once in a fortnight preferably on Sundays between 10.00 am to 05.00 p.m. before the concerned Police Station, till filing of charge sheet. viii) He shall not involve himself in similar offence during pendency of the case.
