1. Heard Sri Harish Chandra Mishra, learned counsel for the applicant, and Sri Rajeev Kumar Singh, learned A.G.A for the State and perused the material available on record.
2. Applicant seeks bail in Case Crime No. 95 of 2024, under Sections 411,413 of I.P.C., Police Station - Lahchura, District - Jhansi, during the pendency of trial.
3. Learned counsel for the applicant submitted that applicant has been falsely implicated in the instant case on the basis of recovery of motorcycle though the same was identified by its owner. It is further submitted that the applicant has explained criminal history of 10 cases. The applicant is a law abiding citizen and is languishing in jail since 31.05.2024. In case, he is granted bail, he will not misuse the liberty of bail and would cooperate in the trial proceedings.
4. Per contra, learned State Law Officer for the State opposed the prayer for bail and submitted that first information was lodged on the basis of recovery of a motorcycle which was stolen by the applicant and the same was also identified by its owner, therefore, the applicant is not entitled to be released on bail.
5. Considering the aforesaid submission of the learned counsel for the parties and taking into account that the stolen vehicle was recovered from the possession of the applicant and he has criminal history of 10 cases which was of similar nature. From the bare perusal of the bail orders of the previous cases, he was released on the condition that he will not commit similar offences but the the applicant kept on committing the similar type of offences and kept on violating the condition of bail.
6. Therefore, considering the fact that the applicant should remain in jail to prevent him to commit further offence and for ensuring his presence before the Trial Court, this Court is not inclined to grant bail to the applicant at this stage.
7. Accordingly, the present bail application is rejected. Order Date :- 14.7.2025 PS Digitally signed by :- POOJA SHARMA High Court of Judicature at Allahabad
