ORDER:
The present writ petition came to be filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue a Writ of Mandamus or any other appropriate Writ Order or direction declaring the action of the 2nd respondent in not completing the enquiry in Rc.No.D1CS/2481/2023 dated 26.12.2023 is illegal, arbitrary and violation of principles of natural justice consequently set aside the same ….”
2. The petitioner was appointed as a Fair Price Shop Dealer of Shop No.1285136 situated at Door No.28-3-845, Neethaji Nagar, Anantapuramu Town & Mandal in the year 2021. The petitioner’s authorization has been renewed from time to time and same is valid up to 31.03.2025. 3.
The case of the petitioner is that, due to a change in political scenario, certain political leaders are trying to grab the petitioner’s Fair Price Shop dealership by influencing respondents No.2 and 3 to allot the stocks for the month of August 2024 to third parties of their own choice. It is further stated that, on 05.12.2023, the inspecting officials inspected the petitioner’s shop and having found certain variations in the stocks, has prepared a panchanama in the presence of mediators. Thereafter, the 2nd respondent issued a show- cause notice dated 26.12.2023, framing two charges and calling for an explanation from the petitioner, for which, the petitioner has submitted an explanation on 27.12.2023, denying the charges. petitioner is that, despite submission of the explanation, no further action has been initiated by the 2nd respondent. Hence, the writ petition is filed. 4. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Civil Pleader. 5. Learned Assistant Government Pleader for Civil Supplies has furnished a copy of instructions of the Tahsildar, Ananthapuramu Urban, vide Rc.No.DICS/1519/2023, dated 28.10.2025, duly enclosing the proceedings of the 2nd respondent vide D.Dis.No.DICS/2481/2023 dated 15.07.2025 through which the petitioner’s authorization has been suspended. 6. Though the learned counsel for the petitioner has disputed the issuance of suspension order dated 15.07.2025, on perusal of the proceedings, it appears that it has been endorsed by the petitioner on 11.09.2025 at about 11.48 a.m.
7. In view of the same, instead of going into merits of the case, this Court feels it appropriate to dispose of the writ petition by directing the 2nd respondent to complete the enquiry in pursuance of the suspension order dated 15.07.2025 as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. 8. With the above directions, the Writ Petition is disposed of. No costs. 5 VS,J W.P.No.16792 of 2024
