By means of this petition filed under Article 226, petitioner prays for a direction to the respondent no.3 to clear the terminal dues in respect of her late husband who died in harness while working with the respondent no. 4 on 15.05.2023. Sri Manav Chaurasia has no objection in the event direction is issued to respondent no. 3 to decide the claim of the petitioner in accordance with law. In view of the above, this petition stands disposed of with a direction to the petitioner to make a fresh representation before the respondent no. 3 detailing therein her grievance regarding terminal dues of her late husband to which she is entitled on account of her husband's premature death while working with the respondent establishment within a period of four weeks along with the certified copy of this order and in the event such representation is received, the respondent no. 3 shall consider and decide the same within a further period of two months of course after giving opportunity of hearing to all the parties concerned who may have set up their rival claims. It is further provided that in the event the claim of the petitioner found to be rightful and genuine, the entire post retirement dues shall be paid to the petitioner within a further period of six weeks.
