P Nageswaramma, W/o P.Ramakrishna Reddy, aged 55 years R/o Podaralla Village, B K Samudram Mandal, Ananthapuram District ...Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue a Writ of Mandamus or any other appropriate Writ or Writs, Order or Direction, declaring the action of Respondent No.5 who is holding the post of Respondent No.4 in not registering the complaint made by petitioner on 05.08.2023 and in calling the petitioner and her family members to Police Station frequently and coercing them to settle the matter with 6th Respondent as illegal, arbitrary, without jurisdiction and violative of Art 14 of Constitution of India and to consequently direct the Respondent No. 4 to forthwith register the complaint made by petitioner dated 05.8.2023 and lodge FIR against the accused and also not to call the petitioner and her family members to Police Station without there being any crime registered against them and pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to issue interim directions to the Respondent No. 4 to forthwith register the complaint made by petitioner dated 05.8.2023 and lodge FIR against the accused and also not to call the petitioner and her family members to Police Station without there being any crime registered against them, pending disposal of W P No.of 2023 and pass Counsel for the Petitioner: N RANGA REDDY Counsel for the Respondents: GP FOR HOME THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 22316 OF 2023 The Court made the following order: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a Writ of Mandamus or any other appropriate Writ or Writs, Order or Direction, declaring the action of Respondent No.5 who is holding the post of Respondent No.4 in not registering the complaint made by petitioner on 05.08.2023 and in calling the petitioner and her family members to Police Station frequently and coercing them to settle the matter with 6th Respondent as illegal, arbitrary, without jurisdiction and violative of Art 14 of Constitution of India and to consequently direct the Respondent No. 4 to forthwith register the complaint made by
petitioner dated 05.8.2023 and lodge FIR against the accused and also not to call the petitioner and her family members to Police Station without there being any crime registered against them and pass such other or further orders…” 2. No representation for the petitioner. 3. When the matter is taken up hearing, Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents, on written instructions, would submit that on the complaint made by the respondent No.6 a case was registered against the relative of the petitioner in this matter and that no crime has been registered against the petitioner. It is further submitted that the petitioner was called to the police station only for the purpose of enquiry in the said case. 4. The learned Assistant Government Pleader for Home would further submit that there are civil disputes between the petitioner and unofficial respondents and further that the petitioner filed a Spandana Complaint before the respondent No.2 which was forwarded to the respondent No.4 for enquiry, and in that connection, the petitioner was called to the police station and the contents in the said Spandana Complaint were found to be Civil in nature and the police are not interfering with the civil disputes and never insisted to the parties to settle the issue. 5. Recording the above said submissions, this Writ Petition is disposed of. There shall be no order as to costs.
