The present Criminal Revision Case, filed under Sections 397 and 401 of the Code of Criminal Procedure, 1973 (for brevity, ‘Cr.P.C.'), is preferred by the petitioner/accused, challenging the Judgment dated 16.06.2014 passed in Crl.A.No.143 of 2009 by the learned II Additional Sessions Judge, East Godavari at Amalapuram, (for short, ‘the 1st Appellate Court’). By the said Judgment, the 1st Appellate Court dismissed the appeal, confirming the Judgment of conviction and sentence passed by the learned Judicial Magistrate of First Class, Mummidivaram, (for short, the ‘Trial Court’) in C.C.No.143 of 2009 dated 18.06.2012. 2. Today, when the matter was taken up for hearing, none appeared on behalf of the petitioner. 3. Sri K. Sandeep, learned Assistant Public Prosecutor, appearing for the respondent/State, filed a report submitted by the Sub Inspector of Police, Mummidivaram Police Station accompanied by a copy of the death certificate of the petitioner/accused. A perusal of the said report, along with death certificate, indicates that the petitioner/accused passed away on 03.04.2018. 4. Upon perusal of the judgments rendered by both the Trial Court and the 1st Appellate Court, this Court finds no illegality, error, or perversity in the concurrent findings of the both Courts regarding the conviction of the accused for the offences punishable under Sections 337 and 338 of the Indian Penal Code, 1860, and sections 181 and 196 of the M.V.Act. 3 5. In view of the death of the petitioner/accused, the Criminal Revision Case is dismissed as abated. Interim orders, if any, granted earlier shall stand vacated, and all pending miscellaneous petitions, if any, shall stand closed. ________________________ T.
