Heard learned counsel for the petitioners and learned A.G.A for the State respondents. 2. The relief sought in this petition is for quashing of the F.I.R. dated 09.12.2024, registered as case crime no.0523 of 2024, under sections 191(2), 319(2), 318(4), 338, 336(3), 340(2), 316(2), 351(2) BNS, P.S. Badagaon, District Varanasi. Further prayer has been made not to arrest the petitioners in the aforesaid case. 3. After substantial argument, once we decline to quash the impugned F.I.R., confronted with the situation, learned counsel for the petitioner submits that the instant writ petition may be dismissed as withdrawn and leave may be granted to avail the alternative remedy or pressing an application before the competent court for anticipatory bail/bail. 4. Learned AGA has no objection. 5. In view of the submission made above, the writ petition is dismissed as withdrawn with liberty as prayed to apply before the competent court for anticipatory bail/bail as permissible under law and in accordance with law.
