ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... a Writ of Mandamus declaring the inaction of the respondents 1 to 5 in not registering the case under section 307 IPC against the respondents no.6 and 7 is illegal, unjustice and unconstitutional and seeking a direction to the respondents 1 to 5 to alter the case as under section 307 IPC against the respondents no.6 and 7 as per complaint made by the petitioner dated 03-02-2022 to the respondents and to pass such other order or orders as may deem fit and proper in the circumstances of the case.”
2. None represented for the Petitioner. 3. Sri V.Farooq, learned Assistant Government Pleader, on written instructions, would submit that, based on the MLC intimation and the state of the Petitioner herein, a case in Crime No.58 of 2022 has been initially registered for the offence under Section 324 read with 34 IPC on the file of Sarpavaram police Station. Subsequently, based on the investigation, Section of Law was altered from 324 IPC to 326 IPC and after completion of investigation, charge sheet has also been filed and C.C number is awaited. 4. Considering the submissions made, the Writ Petition is disposed of.
However, the Petitioner is at liberty to work out his remedies before appropriate forum in accordance with law. There shall be no order as to costs.
