Rights in Land and Pattadar Pass Books Act, 1971, as illegal, arbitrary and amounting to abdication of statutory duty cast under the provisions of A.P. Rights in Land and Pattadar Pass Books Act, 1971 and consequently direct the 3th respondent to take appropriate action on the Report of the 5th Respondent, and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents 2 to 5 to consider and dispose the Representations of the Petitioner, dt.27.01.2025, 21.04.2025, 28.07.2025 for grant of separate LPM in relation to the petitioners land in Sy.No.75/4, an extent of Ac.4.45 cts of Pedamushidivada Village, Parawada Mandal, Anakapalle District, and also update of Webland Adangal and Form-1 B in relation to the said land in terms of the provisions of A.P. GP FOR REVENUE The Court made the following: 3 ORDER: The present Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief: “to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus or an appropriate writ or order declaring the inaction of the respondent in considering the Report of the 5th respondent, dt.29.03.2025 vide Rc.No.116/2025/SA, for grant of separate LPM in relation to the petitioners land in Sy.No.75/4, an extent of Ac.4.45 cts of Pedamushidivada Village, Parawada Mandal, Anakapalle District, and also update of Webland Adangal and Form-1 B in relation to the said land in terms of the provisions of A.P. Rights in Land and Pattadar Pass Books Act, 1971, as illegal, arbitrary and amounting to abdication of statutory duty cast under the provisions of A.P. Rights in Land and Pattadar Pass Books Act, 1971 and consequently direct the 3th respondent to take appropriate action on the Report of the 5th Respondent, and pass….” 2. Heard M/s Surya Kiran Kumar, learned counsel for the petitioner, learned Assistant Government Pleader appearing for respondents. 3. Learned counsel for the petitioner submitted that basing on the representations of the petitioner, respondent no.5 has enquired and submitted a report to respondent no.3 on 29.3.2025 and despite receipt of the same, respondent no.3 has not considered and passed any order. Hence the Writ Petition. 4. Learned Assistant Government Pleader appearing for respondents, on instructions, has submitted that the respondents would pass appropriate orders. 4 5. Considering the said submissions, without going into the merits of the case, as already respondent no.5 has submitted a report to respondent no.3, in view of the same, respondent no.3 is directed to consider the report, if required, by getting further report from the concerned officers, and pass appropriate orders, within a period of two (02) months from the date of receipt of a copy of the order. 6. With the above observation, the Writ Petition is disposed of. No costs.
