Learned counsel for the petitioner submits the Respondent No.02 had filed an application dated 20.08.2024 before the Respondent No.01 against the Petitioner, alleging therein that Petitioner had continuously developing physical relation with her since 12 years on the pretext of marriage and ultimately denied to perform the marriage. The application of the petitioner was accepted by the Respondent No.01 and proceeded further vide order dated
18.09.2024. The Respondent No.01 vide its order dated 20.11.2024, the Respondent No.02 was directed to file First Information Report against the Petitioner. It was further directed the Respondent No.02 to take action for termination of service of Petitioner on account of physical pain, mental agony etc. On which, the Petitioner has submitted that he will make payment of Rs. 20,00,000/- to the Respondent No.02 in lieu of full and final settlement within a period of two months. The Respondent No.01 has fixed the case for 09.12.2024 for payment by the Petitioner. The father of the Petitioner and the brother of the Respondent No.02 appeared before the Respondent No.01 and had submitted an agreement along with cash of Rs. 10,00,000/- and a Post Dated Cheque of Rs. 10,00,000/-, which were accepted by the Respondent No.02. Thereafter, the Respondent No.01 has passed an order for marital bondage of 02 years and the parties will comply with the same. The Petitioner after passing the impugned order 09.12.2024, the Petitioner has filed an application before the Respondent No.01 13.12.2024, requesting for "Completely free from marital bondage of 02 years". Thereafter, waiting for a period of about 03 months, the Petitioner had again moved an application
3 dated 19.03.2025 before the Respondent No.01. Both the applications are still pending with the Respondent No.01. Hence this petition.
3. I have heard learned counsel for the parties and perused the material available on record.
4. Considering the facts and circumstances of the case, instead of keeping the present writ petition pending, I find it appropriate to dismiss the petition of the petitioner as no ground is made out by the petitioner which warrants interference because the dispute is between petitioner and private party, as such the present writ petition is not maintainable. Accordingly the writ petition is dismissed. Sd/-
