HARI HARANADHA SARMA FAMILY COURT APPEAL No.37 of 2025 JUDGMENT: (Per Hon’ble Sri Justice A.Hari Haranadha Sarma) Against the order and decree, dated 30.12.2024, the present Appeal is filed. The proceedings before the learned Judge, Family Court-cum-III Additional District & Sessions Judge, at Srikakulam were initiated for dissolution of marriage and grant of divorce. The same was allowed and a permanent alimony of Rs.10.00 lakhs was granted in favour of the wife. Questioning the dissolution of marriage, no Appeal is filed. 2. Both the parties appeared virtually and they are identified by the respective counsels. 3. As per the joint memo filed by both parties, the permanent alimony granted by the trial court is consented to be modified to Rs. 7.00 lakhs. Both parties have been identified by the learned counsel on either side, and the signatures of both the parties and their respective counsel are appended to the memo. 4. In view of the joint memo, the Appeal is disposed of, modifying the permanent alimony amount to Rs.7.00 lakhs instead of Rs.10.00 lakhs. 2 5. Further, it is stated that Rs.2.00 lakhs has been paid in the form of Demand Draft and the remaining amount of Rs. 5.00 lakhs has already been deposited before the trial court. 6. The appellant/husband submitted no objection for withdrawal of the amount deposited. 7. In view of the same, the respondent/wife is entitled to withdraw the amount before the trial court, without furnishing any security and the learned Family Court shall entertain the same. 8. Accordingly, the Family Court Appeal is disposed of. There shall be no order as to costs.
