IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.14755 of 2025 Bidyadhar Rout …. Petitioner Mr. S.K. Rout, Advocate -Versus- State of Odisha …. Opposite Party Ms. S. Mohanty, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 29.01.2026 02. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Soso P.S. Case No.233 of 2025 corresponding to G.R. Case No.553 of 2025 pending in the court of learned J.M.F.C., Hatadihi on the grounds stated. 3. Perused the FIR as at Annexure-1. It is revealed from the report that the victim went missing, hence, the informant father lodged the same. Learned counsel for the petitioner submits that the victim though a minor is presently staying with the present accused. It is claimed that both of them have married in the meantime. In spite of an order dated 24th December, 2025 of this Court, the statement of the victim recorded under Section 183 BNSS has not been received by learned counsel for the State. But considering the fact that the victim allegedly eloped with the petitioner and hence, the report i.e. Annexure-1 lodged by the informant father and recording the submission that she is at present with the accused and staying together, this Court, though not inclined to grant pre- arrest bail to him is of the view that he should be directed to surrender before the learned court below to go on bail with suitable conditions and upon verification vis-a-vis whereabouts of the victim with an inquiry held. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL petition stands disposed of with a direction to the petitioner to surrender before learned J.M.F.C., Hatadihi within a fortnight from today and in the event, he surrenders in compliance thereof, shall be released on bail in connection with G.R. Case No.553 of 2025 on furnishing a bail bond of Rs.40,000/- (rupees forty thousand) with one solvent surety for the like amount to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case and subject to compliance of the directions as above. 6. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik) Judge Balaram Designation: PERSONAL ASSISTANT
