JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioner/accused arrested in connection with a case registered at Holalkere Police Station, Chitradurga in Crime No.212/2025 has preferred this petition to enlarge him on bail. 2. FIR is registered on a complaint lodged by the Police constable working at Holalkere Police Station. It is alleged that on 16.07.2025 at about 7.45 p.m., he and another police by name Chandrappa were on rounds and at that time they heard some commotion near a car washing shop situated by the side of My Bake Bakery, wherein two persons were found fighting with each other and one of them tried to assault another person with a chopper. In the fight, both of them sustained certain injuries and on seeing the police, they fled away from the spot. - 3 - HC-KAR NC: 2025:KHC:38309 CRL.P No. 12231 of 2025 3. In the complaint it is alleged that on enquiry, complainant came to know the name of the accused. However, it is pertinent to mention that no complaint was lodged by any of the injured. Even, according to the complaint, injured were not admitted to any hospital. It is not stated in the complaint that from what source, the police came to know the names of the accused who indulged in the fight. 4. Petitioner was arrested on 17.07.2025. He has been interrogated. He is in judicial custody. In the facts and circumstances, by imposing necessary conditions, petitioner can be enlarged on bail. Accordingly, the following: ORDER i. Petition is allowed. ii. Petitioner/accused in Crime No.212/2025 of Holalkere Police Station, Chitradurga, shall be enlarged on bail, subject to following conditions: - 4 - HC-KAR NC: 2025:KHC:38309 CRL.P No. 12231 of 2025 1. He shall execute a bond in a sum of Rs.50,000/- (Rupees Fifty Thousand only) with a surety for the likesum to the satisfaction of the jurisdictional Court. 2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address. 3. He shall not directly or indirectly tamper with the prosecution witnesses. 4. He shall not indulge himself in committing any offence. 5. He shall appear before the trial Court on every date of hearing without fail.
