1. Mr. Saurabh Kumar Pandey, learned counsel for the applicant.
2. Mr. Siddharth Bisht, learned A.G.A. with Mr. Himanshu Sain, learned Brief Holder for the State.
3. Present applicant Rohit, S/o Man Singh is praying for regular bail in relation to FIR dated 16.01.2025 registered as FIR No. 0024 of 2025 at P.S. Kiccha District Udham Singh Nagar wherein the present applicant has been implicated for the offences punishable under Sections 64, 87 and 137(2) of BNS 2023 read with Section 5 and 6 of the POCSO Act.

Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated, and, in fact, the applicant was in love with the victim which is evident from the statement of the victim recorded under Section 183 of BNSS 2023 wherein she admits about the love in between both of them. He further submits that though the victim was minor and applicant was major at the time of incident but both of them were at tender age were in love. He further submits that since charge sheet has already been filed therefore, there is no need of custodial interrogation of the present applicant.
5. Learned Brief Holder for the State has not disputed this fact that charge sheet has already been filed.
6. After hearing the arguments of the
learned counsel for the parties and further taking into consideration that charge sheet has already been filed and
2025:UHC:4304 there is no need of custodial interrogation of the applicant and furthermore applicant has no previous criminal history this Court is of the view that the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
13. Let the applicant Rohit be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
