SHAIK FAQMDDIN AGED ABOUT 33 YEARS, R/O. 4-56A, OSMANIA COLLEGE ROAD, KALLURDARWAZA, KURNOOL. ...PETITIONER/ACCUSED AND THE STATE OF ANDHRA PRADESH, Rep. by S.H.O, Kurnool I Town P.S. ...RESPONDENT/COMPLAINANT Petition under Section 437/438/439/482 of Cr.P.C and 528 of BNSS praying that in the circumstances stated in the Memorandum of Grounds of Criminal Petition, the High Court may be pleased to direct the Respondents to release the petitioner herein on anticipatory bail in the event of his arrest in Crime No. 185/2025 of Kurnool I Town P.S., registered for the offences punishable under Sections 115(2), 118(1), 126(2), 109(1), 351(2), 79 r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023, Counsel for the Petitioner/accused: MEDAPATI SANTOSH REDDY Counsel for the Respondent/complainant: PUBLIC PROSECUTOR The Court made the following: 2 Dr.YLR,J CRL.P.No.9891/2025 Dt:31.10.2025 ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused No.3 for granting of pre-arrest bail in connection with Crime No.185 of 2025 of Kurnool I Town Police Station, Kurnool District, registered for the alleged offence punishable under Sections 115(2), 118(1), 126(2), 109(1), 351(2), 79 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. 3. The wound certificate received by the Investigating Officer reveals that the victim suffered only simple injuries. The Petitioner/Accused No.1 is a Corporator. There is a counter case filed by Accused No.1 against the other people, there is a political rivalry in between the Petitioner and the supporters of the de-facto complainant. 4. Considering the facts and circumstances, the gravity and nature of the allegations levelled the Petitioner, this Court is inclined to grant pre-arrest bail to the Petitioner/ Accused No.3. 5. In the result, the Criminal Petition is allowed with the following conditions: i. In the event of arrest of the Petitioner/Accused No.3, he shall be enlarged on bail subject to he executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two 3 Dr.YLR,J CRL.P.No.9891/2025 Dt:31.10.2025 sureties for the like sum each to the satisfaction of the arresting police officials; ii. The Petitioner/Accused No.3 shall make himself available for investigation as and when required; iii. The Petitioner/Accused No.3 shall not cause any threat, inducement or promise to the prosecution witnesses; iv. The Petitioner/Accused No.3 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. v. The Petitioner/Accused No.3 shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. vi. The Petitioner/Accused No.3 shall surrender his passport, if any, to the investigating officer. If he claims that he does not have passport, he shall submit an affidavit to that effect to the Investigating Officer. _________________________ DR. Y.
