Mr. Aditya Bohra, Adv. For Respondent(s) : Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE ANAND SHARMA Order 16/12/2025 1. This criminal misc. bail application has been filed by the petitioner under Section 483 of BNSS, 2023 in respect of FIR No.42/2025 registered at Police Station Jyoti Nagar, Jaipur City (South) for the offences punishable under Sections 420 and 406 IPC. 2. It is submitted by learned counsel for the petitioner that petitioner is Chief Executive Officer of United Multistate Credit Cooperative Society, Jaipur. Earlier during enquiry, the Officer of SOG demanded bribe, which was objected by the petitioner and a complaint was made by the petitioner. In order to threaten the petitioner as well as to pressurize him for withdrawing FIR, earlier [2025:RJ-JP:50629] (2 of 4) [CRLMB-16281/2025] one FIR No.44/2020 was lodged against the petitioner in which there is a reference that payment of 3299 investors amounting to Rs.5.35 Crores has not been made by the Society. It is submitted that in respect of the said FIR, petitioner has been enlarged on bail vide order dated 09.06.2022 passed by the Co-ordinate Bench of this Court in S.B. Criminal Miscellaneous Bail Application No.8568/2022. 3. Thereafter, many investors also individually lodged FIR against the petitioner in respect of same incident and taking note of the fact that FIR No.44/2020 was already lodged by SOG against the petitioner in which the petitioner was enlarged on bail, in subsequent FIRs also benefit of bail has been granted to the petitioner vide order dated 14.07.2022 passed in S.B. Criminal Miscellaneous Bail Application No.9604/2022, order dated 15.07.2022 passed in S.B. Criminal Miscellaneous Bail Application No.9606/2022, order dated 18.07.2022 passed in S.B. Criminal Miscellaneous Bail Application No.10665/2022, order dated 27.07.2022 passed in S.B. Criminal Miscellaneous Bail Application No.11513/2022, order dated 03.08.2022 passed in S.B. Criminal Miscellaneous Bail Application No.11972/2022, order dated 27.08.2022 passed in S.B. Criminal Miscellaneous Bail Application No.12317/2022 and order dated 06.09.2022 passed in S.B. Criminal Miscellaneous Bail Application No.12284/2022. 4. It is submitted that now three years thereafter again the similar FIR has been lodged by one of the investor, whereas the lead FIR No.44/2020 is already being prosecuted by SOG [2025:RJ-JP:50629] (3 of 4) [CRLMB-16281/2025] against the petitioner. Hence, under these circumstances, a prayer has been made to grant bail to the petitioner. 3. Learned Public Prosecutor has vehemently opposed this bail application and stated that the investigation is being made by SOG against the misdeeds and cheating committed by the Society. Therefore, the petitioner may not be granted benefit of bail in this matter. 4. Considered the submissions made at Bar. 5. In view of the fact that in respect of lead FIR No.44/2020 lodged by SOG as well as in respect of all subsequent FIRs lodged by individual investors having similar allegations, petitioner has been granted benefit of bail, without expressing any opinion on the merits and demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 6. Accordingly, this Bail Application is hereby allowed. The accused-petitioner Dinesh Kumar Kukreja S/o Late Shri Chandrapal shall be released on bail in pursuance of FIR No.42/2025 registered at Police Station Jyoti Nagar, Jaipur City (South) on furnishing a personal bond of Rs. 1,00,000/- along with two sureties of Rs.50,000/- each.
