ORDER: The Criminal Petition has been filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.’)/ Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the petitioner/Accu sed No.4 on bail in Crime.No.1111 of 2021 of Penamaluru Police Station, Vijayawada City, registered against the petitioner/Accused No.4 herein for the offences punishable under Sections 457 and 380 of the Indian Penal Code, 1860 (for brevity ‘the IPC).
2. Heard the
learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, a case was registered in the year 2021 as FIR No.1111 of 2021 of Penamaluru Police Station. Nearly four years after registration of the crime, the petitioner/Accused No.4 was arrested. There are no criminal adverse antecedents reported against the petitioner. The role of the petitioner came to light based on the confession of Accused No.3. The charge sheet was filed after thorough investigation. No injuries were suffered by the victims of the offence. The petitioner was arresfed on 27.04.2025 and he has been in judicial

The petitioner is a permanent resident of Gulbar Village, Garbhada Mandal, Japibua Post, Dohar District, Gujarat I ’ State, and he has got fixed abode. If he is enlarged on bail, he may not evade the process of law since the investigation has been completed, and the petitioner is not in a position to tamper with the evidence. There are no criminal adverse antecedents reported against the petitioner. 4. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the petitioner/Accused No.4, this Court is inclined to enlarge the petitioner/Accused No.4 on bail with the following stringent conditions: i. The petitioner/Accused No.4 shall be enlarged on bail subject to he executing a bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties each for the like sum each to the satisfaction of the learned VI Additional Judicial Magistrate of First Class, Vijayawada. ii. The petitioner/Accused No.4 shall appear before the learned Trial Court on each and every adjournment without fail. 4 Dr. YLR, J CriP.No.10520 of2025 Dated 29.10.2025 iii. The petitioner/Accused No.4 shall not leave the limits of the District without prior permission from the learned Trial Court concerned. iv. The petitioner/Accused No.4 shall not commit indulge in commission of any offence in future. V. The petitioner/Accused No.4 shall not, directly indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court. or or
