G4/497/2019, dated 03.03.2020, whereby and whereunder the land of the 1 petitioner of a total extent of Ac. 6.01 Cents situated in Sy.Nos. 405 and 406 1 A3, the land of the 2na petitioner of a total extent of Ac. 8.01 Cents in Sy.Nos. 405 and 406 1A5 and the land of the 3ra petitioner of an extent of Ac. 3.50 Cents in Sy.No. 406 1A6 of Anaparthi Village and Mandal, East Godavari District is sought to be acquired for House sites to the poor under Navarathnalu Pedalandariki Illu Scheme as illegal, arbitrary, unjust and mala fide exercise of power conferred under the Central Act No. 30 of 2013 as amended by A.P Amendment Act No. 22 of 2018 and the Rules framed there under and also violative of Article 300 A of the Constitution of India and consequently, direct the Respondents herein to drop all further proceedings in this regard forthwith and pass IA NO: 1 OF 2020 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to grant stay of all further proceedings including eviction from the land of the 1st petitioner of a total extent of Ac. 6.01 Cents situated in Sy.Nos. 405 and 406 – 1 A3, the land of the 2nd petitioner of a total extent of Ac. 8.01 Cents in Sy.Nos. 405 and 406-1A5 and the land of the 3rd petitioner of an extent of Ac. 3.50 Cents in Sy.No. 406-1A6 of Anaparthi Village & Mandal, East Godavari District pursuant to the preliminary notification issued by the 2nd Respondent in Form No. VI(a) vide Ref. GP FOR LAND ACQUISITION The Court made the following Order: Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 2. This Writ Petition was filed declaring the Preliminary Notification, issued by the 2nd respondent in Form – VI (a) under Section 11 (1 ) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act No.30 of 2013) vide Ref. G4/497/2019, dated: 03.03.2020, whereby and where under the land of the 1st petitioner of a total extent of Ac. 6.01 Cents situated in Sy.Nos. 405 and 406-1 A3, the land of the 2nd petitioner of a total extent of Ac. 8.01 Cents in Sy.Nos. 405 and 406-1A6 of Anaparthi Village & Mandal, East Godavari District is sought to be acquired for House sites to the poor under ‘Navarthnalu-Pedalandariki Illu’ Scheme. 3. On the other hand, the learned Assistant Government Pleader relying upon the written instructions of the 4th respondent dated 22.12.2025 submits that the 2nd respondent has issued withdrawal Notification for the lands stated in the Writ Petition and it is herewith enclosed for perusal. 4. In view of the above said facts and circumstances and upon consideration of the written instructions of the 4th respondent, dated 4 HBKM,J W.P.No.8547 of 2020 22.12.2025, no further orders are necessary in this matter as no cause survives. 5. Accordingly, this Writ Petition is dismissed as infructuous. Interim order if any deemed to have been vacated. There shall be no order as to costs. The written instructions of the 4th respondent dated 22.12.2025 shall be made as part of the Court record.
