VIBHU BAKHRU, CHIEF JUSTICE) 1. The complaints have filed the present complaint alleging wilful disobedience of the order dated 25.04.2024 passed by the learned Single Judge in W.P. No.12319/2024 whereby, the learned Single Judge had directed the accused to conduct phodi and durast in terms of the application dated 29.09.2022 filed by the complainants. 2. The accused has preferred an appeal against the said decision on the ground that the proceedings of cancellation of the grant of the subject land have been initiated. In addition, it is contended that the subject land is included in the preliminary notification for acquisition and names of the complainants and several land - 4 - HC-KAR NC: 2025:KHC:46278-DB CCC No. 840 of 2024 holders have mentioned in the preliminary notification. It is stated that once the preliminary notification is being issued for acquisition of the subject land, the phodi and durast would not required to be conducted. 3. Without going into the merits of the contentions advanced by the accused, it is apparent that there are substantial grounds on which the phodi and durast have not been conducted. We are unable to accept that the inaction would amount to wilful disobedience of the orders of the Court. 4. In view of the above, the complaint is closed.
