1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.183/2025, registered at Police Station - Raipur, District -Balrampur – Ramanujgaj (C.G.) for the offence punishable under Sections under Sections, 4,6 and 10 of the C.G. Krishak Pashu Parirakshan Adhiniyam and Section 11(1) (d) of the Prevention of Cruelty to Animal Act. 2. 2 Rajpur stated that the other Co accused person accused were carring 3 Nag Buffaloes and beating. Thereafter the Police Station - Rajpur registered a case as a crime No. 183/2025 for the offence punishable under section 4, 6, 10 of the C.G. Krishak Pashu Parirakshan Adhiniyam and section 11(1)(d) of the Prevention of Cruelty to Animal Act against the other co accused person after that, the police station Rajpur during the investigation the only basis of the memorandum of the other co-accused person the present applicant is implicated in this case as accused. 3. The applicant has been falsely implicated in this case, and no prima facie case has been made out against him. He is an innocent person who has been falsely roped into the offence due to enmity and has no criminal background. The entire prosecution is false and concocted. The applicant has not committed any offence as defined under Sections 4, 6, and 10 of the C.G. Krishak Pashu Parirakshan Adhiniyam and Section 11(1)(d) and (m) of the Prevention of Cruelty to Animals Act. The FIR was lodged against another co-accused by the complainant, and solely on the basis of the memorandum of the said co-accused, the present applicant has been implicated, even though he was not present at the place of the incident.
Though the applicant is the owner of the said vehicle, he was not present at the spot at the relevant time, therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application of the present applicant. 5. I have heard learned counsel for the parties and perused the case diary. 3

Considering the facts and circumstances of the case, the submissions made by learned counsel for the parties, the nature of the dispute, and the material available on record, and since one co-accused, namely Firoj Ansari, has already been granted anticipatory bail by this Court in MCRCA No.1430 of 2025 vide order dated 16.09.2025, without expressing any opinion on the merits, I am inclined to grant anticipatory bail to the present applicant

Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant - Govind Lakda, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
