Court No. - 10 Case :- WRIT - C No. - 15619 of 2025 Petitioner :- Rahul Gupta Respondent :- State Of Up And 2 Others Counsel for Petitioner :- Ashok Kumar Yadav,Rituvendra Singh Nagvanshi Counsel for Respondent :- C.S.C. Hon'ble Piyush Agrawal,J. Heard learned counsel for the petitioner and learned standing counsel for State - respondents. The sole prayer made by the petitioner in the instant writ petition is for a writ of mandamus directing the respondent to refund the excess amount of stamp duty as has been paid during the execution of the sale deed dated 27.01.2025. At the very outset, learned Standing Counsel raises a preliminary objection with regard to maintainability of the writ petition on the ground that no mandamus can be issued for refund of the amount without there being any application. To the said submission, learned counsel for the petitioner submits that the petitioner has purchased an agricultural land, in which excess amount has been paid treating the land to be residential, to which an application dated 20.05.2025 has been sent to the authority concerned through registered post. He prays that the same may be directed to be decided expeditiously. Considering the facts and circumstances of the case, without entering into the merits of the case, this writ petition is disposed of with a direction to the authority concerned to decide the petitioner's aforesaid application, in accordance with law, expeditiously, preferably, within a period of four months from the date of presentation of a certified copy of this order.
