Rajendra is present before the Court and learned counsel for respondents, Ms. N. Savitri is also present before the Court physically. The proceeding in CRP (C.R.P. Art. 227) No. 75 of 2019 is connected with MC [CRP (C.R.P. Art. 227)] No. 1 of 2025 and MC [CRP (C.R.P. Art. 227)] No. 14 of 2023. Whereas MC [CRP (C.R.P. Art. 227)] No. 1 of 2025 has been filed under Order 22 Rule 2 of the Code of Civil Procedure whereby in that application seeking for survival of the aforesaid proceeding in CRP (C.R.P. Art. 227) No. 75 of 2019 in respect of petitioner 1 which is a registered society. However, in this application reveals as that petitioner No. 2, who was a member of the petitioner No. 1/registered society has passed away KABORAMBA M SANDEEP SINGH Digitally signed by KABORAMBAM SANDEEP SINGH Date: 2025.06.20 15:23:14 +05'30' Page | 2 and therefore keeping in view the reasons stated in the aforesaid application that has been filed under Order 22 Rule 2 CPC, it is deemed appropriate that the proceeding against petitioner No. 2 do not survive for consideration but the proceeding in CRP (C.R.P. Art. 227) No. 75 of 2019 has been survived at the instance of petitioner No. 1. Accordingly, MC [CRP (C.R.P. Art. 227)] No. 1 of 2025 is hereby considered in the interest of justice. Consequent upon consideration of the said application, the proceeding in MC [CRP (C.R.P. Art. 227)] No. 1 of 2025 is hereby disposed of. This proceeding has been decided in the presence of learned counsel for the respondents, who also submits that the application may be considered. This submission which is made by the learned counsel for the respondent is also taken on record. Consequently, Registry is directed to list CRP (C.R.P. Art. 227) No. 75 of 2019 and MC [CRP (C.R.P. Art. 227)] No. 14 of 2023 on 17.07.2025. Whereas, keeping in view the submission made by learned senior counsel for the petitioner that an interim order has already been granted in these matters, and the same shall be extended till the next date of hearing.
