(At Present Accused Petitioner Confined In Sub Jail Deeg). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Rahul Sinsinwar For Respondent(s) : Mr. Amit Gupta, P.P. HON'BLE MR. JUSTICE VINOD KUMAR BHARWANI Order 08/12/2025 1. The present 2nd bail application has been filed under Section 483 of B.N.S.S. on behalf of the petitioner, namely Kishor S/o Ballo, in connection with FIR No.199/2025, registered at Police Station Nagar, District Deeg for the offence(s) under Section(s) 189(2), 109(1) & 61(2)(a) of B.N.S. and Section 3/25 of Arms Act. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case, he has nothing to do with the alleged offence(s) and he is behind the bars since 03.09.2025. After investigation, charge-sheet has been filed in the matter. Looking to the overall facts and circumstances of the case, the petitioner is entitled for regular bail in this matter. 3. Learned Public Prosecutor has vehemently opposed the bail application and submitted that the petitioner, along with the other co-accused persons, fired at the complainant, and three persons, [2025:RJ-JP:49786] (2 of 2) [CRLMB-16185/2025] namely Mahendra, Hemraj, and Manohar have sustained firearms injuries and ammunition has also been recovered from the petitioner. Thus, the 2nd bail application filed under Section 483 B.N.S.S. deserves to be dismissed. 4. Heard. Perused. 5. As per the statements of the injured persons, namely Mahendra, Hemraj, & Manohar and the injury report, they had sustained firearm injuries. 6. Thus, without commenting upon the merits/demerits of the case and looking to the overall facts & circumstances of the case, this Court does not deem it appropriate to grant the benefit of regular bail to the petitioner. 7. Accordingly, the instant 2nd bail application filed under Section 483 B.N.S.S. is dismissed with liberty to file afresh after recording the statements of the injured, namely Mahendra, Hemraj, & Manohar.
