...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ in the nature of a writ of mandamus or any other appropriate writ, direction, order or orders declaring the action of the 4threspondent herein in not entertain the registered sale deed to the prospective purchasers in respect of the lands in an extent of 2000 sq.yards or 1672 sq meters or A cents in part and parcel of New Sy.No. 179/2, old Sy.No.2A-4 situated at Chinamushidiwada village accounts, Visakhapatnam District, despite approached the 4th respondent herein on 18-10-2025 for registration as wholly arbitrary, illegal and without jurisdiction and void and violated the principles of natural justice and affected our rights guaranteed under article 14.
19(1)(g), 21 and 300(A) of the Constitution of India and consequently direct the 4th respondent herein to receive and process the sale deed as submitted by the petitioners in favour of their prospective purchasers in respect of 2000 sq.yards or 1672 sq.meters or Ac.0-41.32 cents in part and parcel of Sy.No,179-2 or old Sy.N0.2A-4 situated at Chinamushidiwada village accounts, Pendurthi Mandal, Visakhapatna District by virtue of latest Supreme court judgment in K.Gopi Vs Sub- Registrar and others reported in 2025 INSC 462 and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased direct the 4th respondent herein to receive and process the sale deed as and when submitted by the petitioners in favour of their prospective purchasers in respect of the lands in an extent of 2000 sq. yards or 1672 sq. meters or Ac.O-41.32 cents in part and parcel of New Sy.No.179/2, old Sy.No.2A-4 situated at Chinamushidiwada village accounts. ORDER: The present Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief:
“to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus or an appropriate writ or order declaring the action of the 4threspondent herein in not entertain the registered sale deed to the prospective purchasers in respect of the lands in an extent of 2000 sq.yards or 1672 sq meters or A cents in part and parcel of New Sy.No. 179/2, old Sy.No.2A-4 situated at Chinamushidiwada village accounts, Visakhapatnam District, despite approached the 4th respondent herein on 18-10- 2025 for registration as wholly arbitrary, illegal and without jurisdiction and void and violated the principles of natural justice and affected our rights guaranteed under article 14.

2. Heard Sri V.Eswaraiah Chowdary, learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 3. During the course of hearing, learned counsel for the petitioners submit that the subject matter of the writ petition is squarely covered by the order of this Court dated 19.08.2015 passed in W.P.No.26437 of
2015. 4
4. Learned Assistant Government Pleader did not oppose the said submission. 5. Having regard to the facts and circumstances of the case and considering the submissions and in the light of the above order of this Court, the respondents concerned are directed to receive and process the document presented by the petitioners pertaining to the subject property, if it is otherwise in compliance of the provisions of the Indian Registration Act, 1908. If the Sub-Registrar refuses to register, he has to pass reasoned order as mandated under Section 71 of the Indian Registration Act, so as to enable the petitioners to prefer an appeal under Section 72 of the Indian Registration Act. 6. With the above direction, the Writ Petition is disposed of at the stage of admission with the consent of both the parties. No costs.
