1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.06/2025 registered at Police Station – Pandri District-Raipur (C.G.) for the offences punishable under Sections – 420, 409, 120-B of IPC.
2. The case of prosecution is that, the FIR is based on financial dealings relating to Q-Three Ventures Pvt. Ltd., involving dishonored cheques and alleged non-fulfillment of business obligations. 2 made a written complaint that the applicant is one of the share holder of private limited company namely Q-three Ventures. The Directors namely Jubin Peter and Karthik Sivan offered him dealership of electronic goods, relying upon the same complainant has transferred the amount in to the account of the Q-3 limited company and not supplied the electronic goods and committed the present offence. It is pertinent to mention here that the present applicant is share holder of the company.
3. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. It is further submitted that the complainant and applicant is a share holder in the company and co-accused, who is the Director namely Kartik Sivan has also been granted regular bail by this Court in MCRC No.3058 of 2025 on 22.04.2025. It is further submitted that investigation and trial is likely to take quite long time for its conclusion, therefore, he prays for grant of bail to the applicant.

On the other hand, learned State counsel as well as learned counsel for the Objector opposes the prayer for grant of anticipatory bail and submits that applicant is a resident of the State of Karnataka and he has two criminal antecedents one is under the Kerala Excise Act and another is Under the Motor Vehicle Act.
5. I have heard learned counsel for the parties and perused the case diary.
6. Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and
submissions made by learned counsel for the parties and co-accused who is the Director namely Kartik Sivan has also been granted
3 regular bail by this Court in MCRC No.3058 of 2025 on 22.04.2025, investigation and trial is likely to take quite long time for its conclusion, this Court is of the view that the applicant is entitled to be released on bail in this case.
7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Anup P. Padmanabhan, on executing a personal bond and one local surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) he shall not involve himself in any offence of similar nature in future.
