The present writ petition has been filed with the following reliefs:- (i) For issuance of an appropriate writ(s), order(s) direction(s) for quashing the order dated 17.12.2024 passed by District Magistrate, Madhubani (Respondent no.4) in Anganwari Appeal Case No.28 of 2024 whereby and where under petitioner has been terminated from the post of Anganwari Sevika Centre no.216, Ward no.4, Sisauni Panchayat under Block Harlakhi, District- Madhubani. (ii) For issuance of an appropriate Patna High Court CWJC No.7576 of 2025(2) dt.02-04-2026 2/5 writ(s), order(s) direction(s) to allow the vide Memo no.509 of 2024 dated 21.03.2024 passed by District Programme Officer, Madhubani in Misc. Case No.36 of 2023 whereby and whereunder quash the appointment of Respondent no.8 and on the basis of merit list appoint the suitable candidates on the post of Anganbari Sevika Centre no.216, Sisauni Panchayat under Block Harlakhi, District- Madhubani and consider the name of petitioner for appointment on the post of Anganbari Sevika Centre No.216, Ward no.4, Sisauni Panchayat under Block Harlakhi, District- Madhubani and consider the name of petitioner for appointment on the post of Anganbari Sevika Centre no.216, Ward no.4 Sisauni Panchayat, Block- Harlakhi, District-Madhubani. 3. Learned counsel for the petitioner submits that the application filed by the petitioner has not been considered at all, and therefore, his grievance is absolutely genuine. He further submits that annexure-6 of the writ petition, is the basis of the claim of the petitioner. 4. Counsel further submits that notice may be issued in this case upon respondent No.8 and then pass order. 5. Learned counsel for the State, on the other hand, submits that counter-affidavit has been filed in this case, but without going through the pleading of the counter-affidavit, the findings of the Collector is itself clear that the Collector has Patna High Court CWJC No.7576 of 2025(2) dt.02-04-2026 3/5 called for entire record and upon pointing out each and every discrepancies with regard to the petitioner, reached on the conclusion and rejected the claim of the petitioner. 6. Upon hearing the parties and perusal of the record, this Court hereby acknowledged the findings of the Collector which states as follows:- “…….. इस izdkj उकत सभी आवेदन के अवलोकन से यह सपषट होता है कक सेकवका पद हेतु कदनांक 20.06.2018 को izFke आवेदन एवं 25.06.2018 को f}rh; एवं कदनांक 26.06.2018 को तृतीय आवेदन समकपरत ककया गया था। परनतु izfri{kh संखया-02 करंकु कु मारी दारा कदनांक 15.06.2018 को जो आवेदन समकपरत ककया गया उसमे dze संखया-02 अंककत है। उनका यह भी दावा है कक उनके दारा आंगनवाडी dsUn संखया-216 पर सेकवका पद हेतु कदनांक 15.06.2018 को आवेदन समकपरत ककया गया था, कजसकी izkfIr रसीद संखया-04, कदनांक 15.06.2018 है। परनतु जब कायारलय दारा izFke आवेदन कदनांक 20.06.2018 f}rh; एवं तृतीय आवेदन dze”k% 25.06.2018 एवं 26.06.2018 को समकपरत ककया गया था, तो ककस izdkj से उनहे कदनांक 15.06.2018 izkIr कराये गये आवेदन पर izkfIr रसीद संखया- 04 कदया जा सकता है। इस izdkj से izfri{kh संखया-02 दारा दाकखल izkfIr रसीद संदेहासपद लगता है। बाल कवकास पकरयोजना पदाकधकारी, हरलाखी दारा उपलबध कराये गये मूल संकचका के अवलोकन से यह बात भी बात izdk”k मे आंया कक izfri{kh संखया-02 करंकु कु मारी के दारा जो आवेदन के साथ जो izek.k i= कायारलय मे उपलबध कराया गया था। उकत izek.k i= को अभयथीर दारा vfHkizekf.kr करके समकपरत नहीं ककया गया है। शेष अभयथीर दारा आवेदन के साथ जो भी izek.k i= दाकखल ककया गया है, को vfHkizekf.kr करके दाकखल ककया गया है। इस izdkj से भी izfri{kh संखया-02 दारा समकपरत आवेदन संदेहासपद izfrr होता है। izfri{kh संखया-02 करंकु कु मारी दारा यह भी दावा ककया गया कक 11.08.2018 एवं कदनांक 16.08.2018 को अपना आपकत आवेदन बाल कवकास पकरयोजना पदाकधकारी, हरलाखी के समक दाकखल ककया गया था। परनतु बाल कवकास पकरयोजना पदाकधकारी, हरलाखी दारा उपलबध कराये गये मूल संकचका के अवलोकन से यह सपषट होता है कक कदनांक 11.08.2018 समकपरत आपकत Patna High Court CWJC No.7576 of 2025(2) dt.02-04-2026 4/5 आवेदन पर ककसी कमीर / पदाकधकारी का हसताकर अंककत नहीं है। इसके अलावे izfri{kh संखया-02 करंकु कु मारी दारा कदनांक 16.08.2018 एवं कदनांक 18.08.2018 को समकपरत आपकत आवेदन के अवलोकन से यह सपषट होता है कक उकत दोनो समकपरत आवेदन मे izfri{kh संखया-02 करंकु कु मारी का हसताकर एक दूसरे से कभनन है। इतना ही नहीं उकत दोनो आवेदन को कायारलय दारा कदनांक 16.08.2018 को ही izkIr ककया गया है। इस izdkj से इससे भी सपषट होता है कक izfri{kh संखया-02 करंकु कु मारी दारा कदनांक 11.08.2018, 16.08.2018 एवं कदनांक 18.08.2018 दाकखल ककये गये आपकत आवेदन कायारलय को गलत ढंग से izkIr कराया गया होगा, कजससे कक izfri{kh संखया-02 करंकु कु मारी को अनुकचत ढंग से लाभ पहुँचाया जा सके अथवा यह भी हो सकता है कक izfri{kh संखया-02 को अनुकचत ढंग से लाभ पहुँचाने के उदेशय से संकचका मे संलगन ककया गया हो। कजला izksxzke पदाकधकारी, मधुबनी दारा पाकरत आदेश के अवलोकन से यह सपषट होता है कक बाल कवकास पकरयोजना पदाकधकारी, हरलाखी से izkIr izfrosnu के आधार पर कजला izksxzke पदाकधकारी, मधुबनी दारा कवकवध वाद संखया-36/2023 मे कदनांक 21.03.2024 को आदेश पाकरत करते हुये अपीलकतार के चयन को कनरसत कर izfri{kh संखया-02 के चयन करने का आदेश पाकरत कर कदया गया। जबकक बाल कवकास पकरयोजना पदाकधकारी, हरलाखी दारा मंतवय कदया गया है कक कदनांक 18.04.2023 को संपनन कवशेष आम सभा मे izfri{kh संखया-02 करंकु कु मारी पकत शयाम सुनदर पासवान के आवेदन को कबना ककसी lk{; के संदेहासपद धोकषत करते हुये कवचार नहीं ककया गया। परनतु बाल कवकास पकरयोजना पदाकधकारी हरलाखी दारा समकपरत izfrosnu एवं कजला izksxzke पदाकधकारी दारा पाकरत आदेश से यह सपषट नहीं होता है कक izfri{kh संखया-02 करंकु कु मारी पकत शयाम सुनदर पासवान के आवेदन को ककस आधार पर वैध होना पाया गया है। जबकक संबंकधत मूल अकभलेख पर उपलबध कागजात के अवलोकन से यह सपषट होता है कक सेकवका पद हेतु कदनांक 20.06.2018 को izFke आवेदन एवं 25.06.2018 को f}fr; एवं कदनांक 26.06.2018 को तृतीय आवेदन समकपरत ककया गया था। उकत तीनो आवेदन पर संबंकधत कमीर का हसताकर कतकथ सकहत अंककत है। परनतु izfri{kh संखया-02 के आवेदन पर ककसी भी कमीर का हसताकर अंककत नहीं है। इस izdkj से izfri{kh संखया-02 करंकु कु मारी पकत शयाम सुनदर पासवान दारा अपने दावे के सापेक मे समकपरत कागजात को कायारलय मे समकपरत होना नहीं माना जायेगा। जब कायारलय को पहला आवेदन कदनांक 20.06.2018 को izkIr है तो यह कै से हो Patna High Court CWJC No.7576 of 2025(2) dt.02-04-2026 5/5 सकता है कक कदनांक 15.06.2018 के आवेदन को izkfIr रसीद संखया-04 कायारलय दारा कदया जा सकता है। अतः izfri{kh संखया-02 करंकु कु मारी पकत शयाम सुनदर पासवान दारा ककया जा रहा दावा गलत है। असतु अपीलकतार का अपील आवेदन को सवीकृ त करते हुये कजला izksxzke पदाकधकारी, मधुबनी दारा कवकवध वाद संखया- कवकवध वाद संखया- 36/2023 मे पाकरत आदेश जापांक 509 / कज० izks ०शा०, कदनांक 21.03.2024 को कनरसत ककया जाता है। बाल कवकास पकरयोजना पदाकधकारी, हरलाखी को कनदेश कदया जाता है कक अपीलकतार को चयन i= कनगरत करना सुकनकशचत करे गे। इस कनदेश के साथ उकत अपील वाद की काररवाई समापत की जाती है। आदेश की izfr के साथ कनमन नयायालय के ” अकभलेख वापस भेजे। 7. Upon perusal of the order passed by the Collector, it transpires to this Court that the Collector being the Appellate Authority has categorically acknowledged upon demanding the entire documents relating to selection process and has find that the requisition of the petitioner is doubtful on the ground of Serial No., date, signature and verification, which have been categorically explained in the operative part of the order. As such, this Court is not inclined to interfere, and hence, dismissed the present writ petition. 8. With the aforesaid directions and observations, the present writ application stands dismissed.
