Mr. Sushil Kumar, learned counsel holding the brief of Mr. Gaurav Singh, learned counsel for the applicant. 2. Mr. Siddharth Bisht, learned A.G.A. and Mr. Himanshu Sain, learned Brief Holder for the State. 3. Present applicant is praying for regular bail in relation to FIR dated 10.12.2024, registered as FIR/Case Crime no. 492 of 2024 at P.S. Piran Kaliyar District Haridwar which was lodged for the offences punishable under Sections 8/21/29 of the NDPS Act against two persons, namely, Parvez and Parvez @ Hafizi Baba. 4. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated. He submits that on the disclosure of the name of the applicant by the other co-accused, he has been implicated. 5. In para 13 he has given reference of three criminal cases against the present applicant, i.e, case crime no. 517 of 2024 which pertains to Section 8/21/60 of the NDPS Act, case crime no. 279 of 2022, which pertains to Section 8/21 of the NDPS Act and case crime no. 452 of 2022, which pertains to Section 2/3 of the Gangster Act. 6. Learned counsel for the applicant submits that in all the aforesaid cases, the applicant has already been enlarged on bail and in this particular case he has been falsely implicated. 7. On the other side, learned State Counsel seriously opposed the bail 2025:UHC:3390 application by saying that the applicant is a habitual offender, particularly, in the similar type of the cases which pertains to the NDPS Act. 8. Having heard learned counsel for the parties and taking into consideration all the aspect and further taking into consideration that the applicant has a past history of the similar nature of cases, this Court is of the view that the applicant does not deserve bail. 9.
